Is there any way to ask the court to drug-test her? I believe that pot stays in your system for as long as 30 days. If they can test her on the spot they're sure to find it.

If you are in the system, work with cw to show proof to judge that she is still using and note the dangers of the children being with her. If you are doing this privately, use a lawyer to petition that children are in danger with her. Seek therapists, teachers, doctors, etc to support this. Since you would not be going for custody, the lawyer should not be hugely expensive. Take one step at a time. First goal: keep kids safe in your home w/limited or no visitation. Second goal: at later date, file for custody. If you say custody, they will jump on you and support mother. Right now, just do away with visitation as much as possible. I agree that demanding drug testing is important.

The boyfriend is moving out or moved out, Either way it's premature for your daughter to ask the judge for overnight visits. You need to ask the Judge to keep the supervised visits for another 6 months and for a drug test, and also suggest to the judge, if the drug test comes out positive she gets placed on routine drug testing for the 6mth period as well. Let him know you are not against supervised visits, and willing to work towards reunification of the family, however you want to assure the childrens safety. Pick your words wisely, even if you feel you want to go for custody later on, do not let them know your plan at this time. Waite for it... You do not want to come across as a meddling GP to the Judge, you need to come across as someone who is helping and assisting the system.

If you need to show a continuous heavy use of pot ask for a hair folicle test rather than the standard urine test. This would show the habitual use at high levels. Results are slower to come back but may help you case because it will show the real extent of the addiction.

Also make sure you are documenting all visits: what happens, how the kids react, what she does during the visit. Document all other contact you have with her as well. This can make a significant difference in the long run, especially if she doesn't make every visit she can have, cuts them short or is not focused on the kids when she is there. I have custody and do this all the time just in case either of the bios ever tries to gain custody back. They will be damned in court by their own actions and lack thereof.

And you need to find out what your Department of Children's Services considers acceptable drugs...they told my daughter last week that marijuana use was OK, but not other drugs
