But, if biomom decides she just can't handle the baby and leaves at least you have a chance of getting custody of her.
You could give her the reasoning that IF something should happen to the baby, and she was unavailable, that it would allow you to consent to treatment.
If she agrees, go to a notary and have a paper drawn up and signed. I know it may not be legally binding but it should do until you can go to court.
Given that she would be agreeing to the arrangement and you would be filing for joint custody, rather than trying to take her's away. You may just be able to go in front of a judge with no lawyers.
In our case, the parents consented, we went to family court, filed papers for custody, a few weeks later we were in front of the judge, he asked a few questions and agreed to sign to give us custody.
Just a thought, I have no idea if it would work where you live.
After watching my husband and me do the real work of raising children, I think she became confident enough that we were the better choice. (And she could go partying without having that burden.) Eventually, she listened to reason and signed the papers giving us custody. Never did show up for the hearing, and hasn't even made mention of getting them back someday so I guess they're ours for the duration.
I told her I'd keep the baby. I put her in daycare.So that's where we are today.My dh seems onboard, I don't know if I should give her to paternal grandparents. I don't know how well I'll do with getting up nights with baby. I have to work. I have to pay the bills. Shes 4 1/2 months. So she should start consistently sleeping through the night soon...I am very tired right now, and was late to work this morning, so I better tighten up.
I guess I'm going to raise 2 grands.
If there is a will.....then there is a way and I'm sure you will figure out a way to do this. At least the baby is safe but I would advise to get it in writing as soon as possible, full custody/guardianship if possible with both parents signing off on you having the child.
That lasted about two more years until she had yet another child and we got all three.
