Does anyone know who has the leagal right to claim the children on their taxes? Bio mom doesnt work and has never worked so she could not claim them. Bio dad has paid some child support but has not seen the kids in over a year and half. He thinks he has the right to claim the kids. I told him he can not claim the kids for the earned income because they have not lived with him for six months of the year.I am afraid when income tax time comes we are going to have trouble with him on getting to claim the children. The bio parents were never married and their have been no court orders giving him the right to claim the children. He is willing to sign all rights of the kids over to us so what makes him think he can claim? Just wondering if anyone knows how this works? I spoke with our case worker and she has no idea on it. Any help would be appreiciated.
