I'm going to try and make this short, sorry if it turns out not to be. For years we have had gaurdianship of our oldest GD. My son (bio dad) has from time to time taken my Gd as a tax credit, yet he hasn't seen or spoken to her in years. Each time this has happened my accountant would get mad at me, because I would allow it. I told him each time it's the mom in me and I still have hope he will come around some day and he is paying court order child support..
My accountant always said the IRS states the person who gets to claim is the one who had the child for a minimum of six months. the IRS is above the courts for claiming child each year.
My accountant was right! In 2011 taxes I claimed after my son. I received a letter that my claim might need to be owed with interest because my GD was already claimed. I was to send the IRS proof GD was living with me. I sent them a copy of the court packet and school record showing she was with me .
I received a phone call yesterday from an IRS agent working on the case.I explained everything to him. The agent said he was closing my case and sending the case to open on my son and he was going to also open past years my son received credit for my GD even though she was living with me. it's called fraud when they do this based on IRS rules! The agent couldn't. Give me an addresss, but told me my son was still in our state, which is another lie from him, cause his grandfather from Florida told me my son called him and said he and his wife were living in NYC.
The best part of the conversation yesterday with the agent was when the agent said to me God bless you for caring for your GD. Some people understand what we are doing!

Our kids' other grandmother tried to claim them falsely, but I got there first. My accountant said that's how it usually works, unless someone complains. So I'll never know if she was contacted by the IRS.
When I was working and my 3 gc were in daycare, the staff all knew my situation. They always made it a point to give my gc extra loving and told me on a daily basis what a wonderful job I was doing. I always appreciated their kind words. It made me feel like I was doing something right when I was always unsure.
Yes the money from the previous years would be nice to have, what would be better is my son learning he can't have credit and leave it alone from now on. I should have been more about us throughout the years. He and his wife has made it clear they are not wanting anything to do with our GD so the gifts are over...lesson learned!
