I am more confused than ever! I told her I am at the point of not being able to work. However I am working two days every other week and thought it was good if you were at least working some. The person at allsup told me I can't file for disability unless I am jobless. So which is it, maybe my age (37) plays into the equation too??? I am still getting all my medical records and journaling often to prepare for the inevitable. Thanks for all replies! Julie

Hi, Julie! Disability varies state to state, and I don't know about Virginia (tho' I live there, too). Also depends if the disability will be coming from feds or from the state. Defintely check the regs to be sure. Wish I could help more! Good luck!

Some advocates prefer that u not be working at all. I have a feeling that's the case here. To be honest with you, it is extremely hard to get disability if u haven't worked in years, so if u are working disability will say u can still work. I haven't worked in 5 years and I'm stll fighting for my disability. I've been fighting for it for almost 5 years. When I retained my lawyer i was working 1 day a week maybe, but 2 months after that i quit altogether. Disability is a difficult proces b ready for a fight and if u con't to work know that u can't qualify for disability. Best wishes!

To win SSA you pretty much have to be so disabled that you are unable to work at any job. At least that is how I understand it.

Youdon'tlook is right. To get Federal Social Security you have to prove to a judge or arbitor that you can not work at "any" job......of course, this all depends on who oversees your application and whether you are rejected the first time or not.

Federal law says that you have to be unemployed to file for Social Security Disability, buttttt sometimes people sneak through the system.

I am basing what I say on information I got from my daughter, who is a lawyer and used to practice Social Security Law.

You can try applying on your own, while still working, but if you hire a lawyer or have Allsup, then they can not apply on your behalf if you are working.

Thanks for all the good info. I think I understand a little better now. I don't know what I will do right now, other than gather information from my doctors, which they don't want to copy for me, because "You do know there's a charge, right?" Well yeah, I do. They looked at me like I was crazy to want copies of my own records. Oh well, it is what it is. Thanks again. Julie

I used Allsup. I wasnt working at all when I started with them. I HAD to go back though and they were ok with it. I worked 10 hours a week. I was approved first try and I still work 12 hours a week. I am 47, own my home and have little debt. I caannot ever work full time again and my Doctores, therapist and rheumy were very good about records, and were very supportive. I could not have waded through all the forms without Allsup! It took about seven months until I got my first check. I only get 900/month so I have to continue to trudge along until I can catch up on old bills.

Did it take you 7 months through the whole process? How long from start to finish? I am thinking about doing FMLA right now, my dr talked to me about it.
