I'd document everything you know to be true and send an email to him and see how he acknowledges it. He may not be expecting you to use it against him, so give him some rope. Start off gentle and get him caught up in little details that showing him admitting certain things.

When it comes to money in the family, there often is no loyalty or appeals to the heart. A promise to pay back is just that, a verbal agreement. Something that can be argued in court that the monies were a gift of sorts.
I'm not an attorney so you should seek out the advice of someone that can advise you of the best legal recourse. He as an attorney can draw up anything he likes but don't sign it without legal representation yourself. I think you've given him enough time to pay back. He'll drag this out forever unless you get him in court.
At the very least, you can tell a lawyer the basics of your agreement and see what your options are.
