what to do about nco

When my husband was arrested 6 months ago they put a nco between us and I think its only on his side....preventing him from contacting me or the kids but I was told if I were to contact him I could go to jail (Im guessing some indirect contact bs) does there come a time when we can contact each other (not kids) or will nco go on forever?

In our state the no contact order lists the persons the defendant is forbidden to contact so I assume you and your children are vicitims in his case. Generally the NCO is issued until a date certain- as in our sons case until he was sentenced it was extended until the next court hearing and then once sentenced the judge extended it for an additional 10 years from his sentencing date.

The NCO is to prevent the defendant from contacting the victim(s) by any means or method- if you are not the victim you can contact the prosecutor and tell him/her you do not wish the NCO to include you as you may have financial or other reasons you need to be able to speak with or write to your husband. Ask them to file a motion with the court to strike your name from the NCO.

Also in our state the defendant (your husband) can be prosecuted for violation of the NCO but the victim(s) can harass by any means the defendant without being charged. You may want to check with the prosecutor or an independant attorney in you area on how they work in your state.
