What do you do about bills, bank accounts, etc....

My son has been in jail for about 6 weeks now. His wife has filed for divorce and moved away, and I'm having his mail forwarded to me. He has several bills that need to be paid. His soon-to-be ex-wife (who I'm still friendly with) still has access to his bank account and has told me she'll get me the passwords to his accounts, but I don't have them yet. What do others do about handling their son's or others' business when they're in jail/prison. Also, should I try and find him a different lawyer to help him with the divorce -- I'm assuming his PD won't help with that, but I don't know for sure. Not sure where to go on this.

Well if wife name is on the accounts she is equally responsible - how long is he in prison? you are not responsible for his bills. I would call the creditors and shock the hell out of them by telling the truth and stop paying the bills - they can sue him but most don't (depends on what it is) - he will not be making money in prison and no one else (except maybe the wife) is responsible for those bills. Look up the laws for creditors in yours or his state and no the facts - in many states there is a statue of limitations on how long they can sue (goes from date of last payment) - and after 7 yrs bad debt fall off a credit report Another things is (and I know you said you have a good relationship with her but ... ) but I would politely ask her to either remove your sons name from the account or take her name off - and if it has enough money in there some of it is your sons!

What you need is Power of Attorney. I have one and was able to settle some bills, close accounts, and file taxes. I agree, some of the $ may be your sons. Settle that, then proceed. I did find out that in this state he would have to be present to open bank accounts tho.

I just talked to my son's lawyer and he agreed that I could get a Power of Attorney so I can take care of some of his things. I know I'm not responsible for paying them, as far as it coming out of my pocket, but if I have access to his bank account and can get the passwords like for his credit card, etc. I could use his veterans disability allowance (or whatever it is he's actually getting) to help pay off some of his debt. His lawyer also said he'd talk to my son next Tuesday when he sees him, about the divorce papers and they can figure out if he needs to get a lawyer for that.

I would be careful, because if he is locked up more than 60 days his disability goes down to 10% till he gets out. This happened to my husband and he got a big bill from the VA. We didn't know about this till he got out. I would contact the VA. they can grant an exception for need.

I agree with what the others have said....do talk to the va about it so they know what's going on yes that money will help pay his debts it could also help with putting money on for him.

Thanks for all this information, especially about him possibly losing some of his benefits! Better to know this now than later. I have a feeling his wife is going to be pretty upset tho, because she was expecting a lot more in child support and was hoping to get some of his VA money. Unfortunately, she's always had trouble living within her means and they've always had money trouble, which I personally think may have been something that contributed to his stress which may have triggered this whole thing.

Before I went to prison. I gave my the fiancee now wife a Durable Power of Attorney. She still has it and will unless I rip it up. It made life much easier for her dealing with all of my financials and property.

My sons attorney served me with papers to pay my sons attorney bill. I told them in court I have never signed of payment of his bill. Then they added courts charges to his bill 450 dollars more. how can I stop this?

If you never agreed to financial responsibility, you do not have to pay. However, depending on state law, his wife may have to due to community property laws.

PathLeader - how dare they serve you with your sons bill! Unless he is a minor of you hired the lawyer (not just if you gave money but if you actually hired him) they cannot make you pay squat!! Stand your ground!

My son's attorney got him to sign a power of attorney. I had to use all his money to pay off some of his bills. I am now paying his monthly payments on the rest of his bills and attorney fees because I want to keep his credit in good standing so he can apply for student loans when he comes home.

I understand about wanting to keep good credit but as i said before bad credit is wiped after 7 years - also you do not need good credit to get federal students loans
