Just take it one day at a time. You don't know what will happen due to this violation, just wait.... (Hugs)

Thank you for replying. I waited and waited for him to come home and got settled into what we now call normal and just cannot believe that this happened. It is just exhausting sometimes.

During all my research, at some point I came across something that mentioned that the "failure to register" has to be willful. While you are waiting, it helps to find out as much as possible. Try doing a "Google" search to see if you can find anything on it, and then print it and have it ready for the lawyer to address. Good luck!

I do not know what others may say but as for me, GIVE ME LIBERTY or GIVE ME DEATH! The SOR is very strict! You GO DIRECTLY TO JAIL! Depending on the "STATE" most laws are differant, but from what I have seen on MOST SOR's 1st offense is 90days plus 2yrs probation, 2nd offense 180 days plus 4 yrs probation, 3rd offense LIFE IN PRISON! Most courts are waived of obligations, if your SOR officer (even PO) feels you VIOLATED the SOR then You are SCREWED! and trust me, they can EVEN violate the Sex Offender if it is something very simple, like NOT having a correct ID. The best answer I can give you since I AM a 1st time Violation, is to READ....READ... READ... the whole damn SOR paper they give you. Under the law, THE SOR Officer MUST present the Offender with ALL RULES and SIGNED SOR Statement for THAT TIME FRAME! I get one every THREE months (4 times a year) and it OUTLINES every rule or violation in it. If he SIGNS it it gives them the POWER to say HE KNEW THIS!!! So, Read the SOR COMPLETELY!

TN SOR LAW: He is GUILTY regardless, ANY SO who violates the SOR is GUILTY, GUILTY, GUILTY......
There is no "Do not pass go and collect $200" I have had about six TN-SOR officers and they all say the same thing, If you get Violated... Your going to jail! NO trial or jury.....

The DA takes the case to the grand jury (indictment) The GJ don't even have to vote, it is presented/stated in open court/ and indicted. Court date set, appear and sentenced all in one WHACK! If he is on Parole/Probation he is AUTOMATIC Violated..... So, he has to (a) do the SOR-V sentence and (b) do the V-P/P sentence which can RACK UP!

I know a SO who was NOT on P/P get violated for the SOR for walking past a playground park.... He had to walk to work and no matter WHICH way you go took you (sidewalk) by this park/playground... He TRIED to fight it in court (Paid Attorney) and even took it to Nashville appeals court, lost and was auto-convicted... Served 90 days in jail plus 2 yrs probation, lost his job & home.... He tried suicide afterwards, (failed to kill himself) and was violated by probation (GET THIS!!!!) for ATTEMPTED MURDER of himself.... Was sent to prison for his probation violation of two years plus got 15 years for the Attempted Murder! He had a jury for his A/M trial and because(guessing on this...) he was a sex offender the jury found him guilty..... TENNESSEE SUCKS!

I had three years of Supervised release. I was violated after 8 months. The Judge gave me 6 months in prison and cancelled the rest of my Supervision. Best feeling ever, I was only under their control for 14 months instead of 36 months.
