TN SOR LAW: He is GUILTY regardless, ANY SO who violates the SOR is GUILTY, GUILTY, GUILTY......
There is no "Do not pass go and collect $200" I have had about six TN-SOR officers and they all say the same thing, If you get Violated... Your going to jail! NO trial or jury.....
The DA takes the case to the grand jury (indictment) The GJ don't even have to vote, it is presented/stated in open court/ and indicted. Court date set, appear and sentenced all in one WHACK! If he is on Parole/Probation he is AUTOMATIC Violated..... So, he has to (a) do the SOR-V sentence and (b) do the V-P/P sentence which can RACK UP!
I know a SO who was NOT on P/P get violated for the SOR for walking past a playground park.... He had to walk to work and no matter WHICH way you go took you (sidewalk) by this park/playground... He TRIED to fight it in court (Paid Attorney) and even took it to Nashville appeals court, lost and was auto-convicted... Served 90 days in jail plus 2 yrs probation, lost his job & home.... He tried suicide afterwards, (failed to kill himself) and was violated by probation (GET THIS!!!!) for ATTEMPTED MURDER of himself.... Was sent to prison for his probation violation of two years plus got 15 years for the Attempted Murder! He had a jury for his A/M trial and because(guessing on this...) he was a sex offender the jury found him guilty..... TENNESSEE SUCKS!
