Slowly but surely, the insane laws are changing.

This is in opposition to federal law that deems accessing in any form construes possession. I hope this goes to the Feds next.

This is a very important case!!! I have said this since 1996 when I was charged with possession of CP because of images that were downloaded unbeknownst to me and unsolicited by me because of the way Prodigy worked. At that time even if we proved that I had never asked for any CP or that I had never searched for any CP the fact that someone had sent emails to my Prodigy user name (by simply right clicking on that username) and the fact that Prodigy automatically pushed that content to a cache folder on my local machine was enough to convict me! Even though that charge was ultimately dismissed as part of the plea agreement (when I plead to the OTHER charge I didn't do!) the fact that I would be convicted despite my innocence was a major contributing factor of why I was convinced by my lying bastard attorney to plead guilty to things that were not even factually supported by what the government alleged!

I read this article on msnbc first thing this morning! If I didn't hate logging in on my phone so much I'd have posted it. THEY ADMIT THE LAWS ARE NOT UP TO DATE WITH TECHNOLOGY. Finally, a win for us!!!

Terry: You are welcome for the share. And, I'm wondering: do you think there's any chance that a precedent like this could be enough to get your conviction set aside/overturned/vacated (whatever the term is)? I would really like to see that happen for folks like yourself and thousands of others in this country who had nothing to do with making/manufacturing or distributing this stuff. It's just wrong and scary that one innocent click can end our lives as we know it.

Even a ruling from the SCOTUS itself isn't enough to get relief from a conviction unless they explicitly rule that their decision is retroactively applicable. And that case isn't even binding case law on any court outside of the district in which it was ruled. That ruling will trickle across other jurisdictions as a citation urging other courts to rule similarly, so it is an important ruling.

My particular case is so messed up there just isn't hope for relief. I have THREE different sex offenses - any one of which if you looked at the facts you would say, "WHAAAAT?!?" The first one happened when I was 20 years old, and I do agree that it was a sex offense as I exposed myself to 3 kids as they were riding down the street on their bikes. There is no excuse for what I did. I served six years of probation for that crime.

Terry: I actually had the chance to read this some time ago when you posted the link for another person on here. I'm sorry that I haven't gotten around to commenting on this until now. I just want to thank you so much for your very candid and honest sharing that you did in your book. When I read it, it put a huge knot in my stomach to know how easy it is to end up being labeled like this. I also admire how you admit to where you went wrong the first time around. You would think that would be enough - for a person who is more mature and who has learned from his mistakes to just admit what he did wrong and move on. But, no, they would rather have you put on a list and castigated on a daily basis. Folks like you who step forward and put the cards on the table are an asset in this fight against these terrible injustices. I personally want to thank you being an encouraging voice on here. I also am praying for you that your most recent situation is resolved in a way that the truth sets you free. If I had to sum you up in one word, Terry, it would be: trusting. Your trusting nature is a good thing, and, sadly it has gotten you hurt. I know there's a God above who has your back, and I pray that justice is meted and that you can move on with your life.
