US Supreme Court Rules On AWA and Retroactivity; R

Very interesting decision and commentary by a majority of US Supreme Court justices. Check out this article:

Pay VERY close attention to the part where the majority of SCOTUS justices say, "...thereby helping to eliminate the very kind of vagueness and uncertainty that criminal law must seek to avoid."

Hmmmm....did they just slip up and admit that the AWA IS criminal law...therefore it is NOT a civil law...therefore it IS subject to constitutional challenges against Ex Post Facto punishment???

Any comments or thoughts on this?

Am I being too "glass-half-fullish" on this??? Or, does this open the door for all retroactive challenges against AWA????

This was the Supreme Court who made this ruling according to the article. I'd hope this opens the doors to thousands of court challenges against AWA!!!

This is from an attorney regarding this matter. Just to clear up some confusion................
"he Court returned the case to the lower court to determine whether the AG's rule was "valid." If the court determines it wasn't, then none of these guys who committed their offenses pre-Act would be required to register."

BUT! It has to be decided in the lower court first! So hold your breath!

WOW...thank you RWsMom for clarifying this. It's all so complicated sometimes. I really hope that the lower court rules favorably.

And after it has been remanded to the lower court, whichever party is dissatisfied with the outcome can then appeal the decision. This could keep going, using tax payer dollars and this man's money as well to do it.

What I would like to see is the Nebraska case make it to SCOTUS, get rid of the registry entirely... But that will be a few years yet.
