What a freaking mess! And I have a sneaking suspicion here that there is more at work here that maybe you do not know about? To address what I mean – first off I have never ever heard of any lawyer that will not take a case – pro bono maybe not but then if you have no money I would think you could get a public defender? Have you contacted civil rights lawyers and furnished the angle that they took your child for no reason? You said you were told that the judge should never have signed the papers – if you remember there were several of us on the board that said that. That judge has absolutely no evidence to do that. I could see it if the rules were that Matt could not live there but that is not the case at all so the baby was there and known to all involved. If I understand this correctly it is only about the paternity, correct? In other words this is not about whether Matt was allowed to be with the baby? Another question, who exactly has the baby? Please tell me the judge did not grant custodial custody to the person claiming paternity with no proof??? That would be big time wrong!! The thing about your visits also raises a red flag for me – regardless of who is taking care of the baby you need to document everything they say and do – I get this really weird feeling that they are setting you up to be able to say you did not come to visit the baby. First of all, no matter the father YOU are the mother and the court had absolutely NO grounds to take your child! Why should you and the baby suffer in this?? If they are making things hard for you to see the baby I would tape them and/or get them to sign something every time you want to visit and they say no.

I am a little torn about the media angle – if it was played as just you and the baby are victims in all this the media coverage might do alright but what a lot of people that don’t deal with SO issues do not realize is that the media coverage could also take a horrible slant that leans towards public opinion that you should never have let your baby be around a SO. That is what most of the public will think.
I think the best advice I have seen from anyone here is to contact the ACLU – ask them that if they cannot help you in this to please give you advice as what you can do. I would send them a letter that starts at the beginning – tell that your husband had permission to live with you and the baby and you have no reason to think that he is not the father and that he is on the birth certificate (the paternity really doesn’t matter anyway because they have made so many mistakes anyway). Tell them how they took the baby with no evidence and the judge’s actions in this. Tell them you are being given a hard time about seeing the baby. Bring up the point that regardless of the father you are the mother and were not given any option to stay with your child. Tell them how you are having a hard time getting information about the progress and logistics of the case – personally I do not think this is something you should try to handle yourselves! Also remember this even if your husband is not the bio father at this point he is the legal father and no matter what they cannot take the baby from his mother because of the bio father – it is just insane and all 3 of you civil rights are being violated all because of the SO status. FIGHT!!!!

Yes this is all about the paternity and us telling them we were not bringing him over anymore. The alleged grandparents have him right now. It was granted to them because at the time we did not have a lawyer so we went in blind and worked out a deal until the DNA test was done. They have temp custody right now. We have been writing down every detail down to the fact that he has been sick since they have had him. I'm not quite sure about the radio station. We are going to talk about exactly where it is aired first. One thing we were talking about was the civil rights being violated. I think we are getting something in the works about it. I have the info for free legal services here in Arkansas. Does anyone know if the guidlines are before or after taxes? I'm always on that line or right above to not be able to get help.

Just a short warning about the media angle. They never make the families of the sex offender sound positive and twist and turn it against you. All they care about is ratings not you and people love to listen to it.

The guy that is helping us out and wants to review the case on radio is also a sex offender. He said its his radio station.
