Does anyone know what happens when you have finished your registration requirements? We live in Ohio. Will the Attorney General send a letter confirming you have completed your required time? My son finished his registration requirements in January, he is no longer listed on the state registry, but the Sheriff dept says he has to continue to register for another year. He has not recieved any notification from the attorny generals office, but he is no longer on the ESORN registry. If he is no longer on the registry, and he does not have anything in writing saying he has completed his requirement, can they arrest him for failure to register? We are at a loss. Our so called Attorney says he will not be notified and that law enforcement expects him to know when he is done. This makes no sense to me. I think he needs something in writing. What do we do? Who do we call? It appears we are on our own, no one will give us an answer. We have come this far, I don't want anymore heartache, for my son and his family as well as myself. Our attorney cost us a pretty penny and has done nothing for us. Any help would be appreaciated. Susie

I could first go back to the court house, or call them to find out if it can be done over the phone
Take all the paperwork you have pretaining to his registration information Also you could call a public defender and ask. Last thought are there any accounts he did not pay?

I would go to the courts and get a copy of his sentence, the Judge, not the Sheriff sets the length of registration( unless the worthless politicians do something to change it). A CERTIFIED copy, the clerk will give you one for a few bucks. I'm not in Ohio but that comes under the Freedom of Information act, a Federal law.
In my state, at midnight of your last day it automatically expunges your requirement from all records (except of course the "rap sheet".
Tell your son that I'm glad for him, Now his life can begin again and to make the most he can of it. After putting up with everything he has nothing should be able to get in his way now. I've got 3 more years and I'm SO looking foreword to it.

It's never over. The fight continues. Just because one might be able to get off the registry, doesn't mean they won't keep them on the registry or put them back on.

There are no court records. My son was never in court nor did he appear in front of a judge. He was not ordered by any court to be put on the registry. It was done by a local sheriff deputy. He put him on the registry based on a story from a nisey neighbor. He was questioned by the sheriff deputy, about the story, and he put him on the registry that very day, and told him based on the story he was a felon and would be on the registry for 10 years. That was in 2001. We havve fought this for the last 10 years and no one would listen or help us. He has now completed the 10 years of hell and they still won't take him off. We have no legal paperwork to prove anything. I have another call to the Attorney General's office, but have not gotten an answer back yet. I have called there so much, if they have caller ID they are probably saying Oh no not her again. But I will not give up. I will keep you posted. Thank you for your well wishes and advice. Susie

So he was never charged or convicted of a crime?
If not, HE IS NOT A FELON! Only a court of law can impose that title on him and only after a conviction can registration can be ordered, the Sheriff does not have that power, HE IS NOT A CONVICTED CRIMINAL!
I would definitley find a good Atty.(CIVIL RIGHTS) and maybe even contact the ACLU and even the Feds.
This is totally unconstitutional, even more so than whats happening to CONVICTED SO's.
Look at amendments 4, 5, 6, 7, 8, and especially 14-section 1, which deals with DUE PROCESS.
This is just plain WRONG! Even the AWA doesn't have the authority to place someone who's never been convicted of a QUALIFYING OFFENCE on the registry.

Ok, so I did a little research and found out that Ohio has a CIVIL SEX OFFENDER REGISTRY, WHICH I'M SUPRISED it hasn't been thrown out in the courts, it is so UNCONSTITUTIONAL and ILLEGAL! since one can be placed on it WITHOUT a criminal conviction!
That being said, it still takes a COURT ORDER, FROM A JUDGE to place anyone on it.
Also, it does NOT place any CRIMINAL SANCTIONS(the reg. is regulatory, YEAH, RIGHT) meaning your son CANNOT be considered a FELON, since he HAS NOT been convicted of CRIME, He can still vote, own firearms and any other thing that all citizens have a RIGHT to.
It sounds to me that you have a MAJOR civil rights complaint against the Sheriff.
Also, if a person is placed on the ILLEGAL civil reg. they can petition the courts for removal after 6 years.
