I was reading Yahoo News and came across an article about testing used on prison inmates, those on parole or probation, and those awaiting criminal sentencing. The article cites the tests used in multiple states and how they are not only inherently flawed, but also serve to imprison people based on their being poor, under-educated, and other such factors.

I read a lot of threads and post on this website and others where posters put such emphasis on some test that can help reduce sentencing or keep a person out of prison - when in fact these test can actually have the complete opposite affect because they are inherently flawed. Personally, I would never put my fate in some test that is premised on a role of the dice in how I am going to be governed because that really is what one does when taking these tests.

While I am greatly concerned about Courts using these tests to determine what criminal sentence to give person, as it creates a seriously unequal application of the law insofar as handing out criminal sentences. A person can get a longer sentence than what he should get, because he is poor or only has a GED, or because he does not like his mom or dad. This is not what judges should be considering when handing out a criminal sentence.
