I have a son who was sold out by his attorney, and was told he should take a plea bargain that was offered to him. When he was preparing to move out of the state of Nebraska, he went in to register his move. The cops of the town harrassed him and claimed they had proof that he was involved in a rash of breakins in the area. They put him in their car and drove over to the house where he was staying. When my son exercised his rights and asked for his lawyer, they finally told him that "he was free to go, and to have a nice flight". When my son inquired about having to fill out the paperwork they told him they "needed nothing further from him". He has 3 witnesses, but they are my nieces, and the cops would not allow them to be with him at all times. My son barely caught his plane flight out of Nebraska. When he got here, I personally took him in to get registered. And of course there is now a problem with Nebraska saying that he "absconded". Is there any where I/we can go for help with this? Legitimate help would be appreciated, as he has a court date back in Nebraska (which we cannot afford the ticket back), on April 19th, 2010.

yes he did this within the AZ 72 hour time frame. We are going to attempt to go about this by sending a letter to the court. Hopefully the judge will listen. I am pointing out that there is no such "written" notification in NE law lb285, and that he did go there to do this, and sending proof that he is registered in the new state.

I've been thinking of changing my major, in college, from computers to Administration in justice. Because these laws definately go overboard in quite a few areas. But I am unsure, beacause it isn't in my nature to "speak up". I would have to go thru a course on public speaking.

I can only suggest that you contact your son's attorney in NE. Maybe he can get clarity from the courts.

Thank you all. And btw, I am getting a bigger voice and learning as much as I can on the laws of this subject. I have talked with 2 different lawyers on this matter. One tells me that my son should come back for the court hearing and the other said that since he's already registered here, he should not worry about it unless he goes back to the other state. I also typed up a couple letters for the judge, states attorney, county sheriff and state sheriff, stating that he did go in and inform them of his move beforehand and that he is registered in his new state. From what I see of Nebraska law and federal law, "written" notification isn't in their wording. Just that the offender is suppose to "notify" them. I added this to the information in the letter.My son got a call from the county sheriff (he left a message), he said that the letter doesn't mean shit to him. There has been no contact from any of the other places. At any reate, I am helping my son to make sure he cries out for a lawyer loud enough the whole place can hear him (so they can't say he didn't ask for one again), and to not say a word to the cops other than that..
