Dear Friends,
I am writing this in hopes that some of you will benefit from my experiences. My husband had been collecting a monthly disability check from social security because he's legally blind. Well, he and I neglected due to ignorance to have me designated as a representative payee to act on his behalf once he became incarcerated. You see, he spoke with them telling them that I will be calling once he's taken into custody to let them know to stop the payments. Social Security will not pay retirement or disability or ssi while the beneficiary is incarcerated.
So, November 6, I called them. Informed them that he's incarcerated and they need to stop his payments. Well, little did we know that in order for them to discuss his benefits with me, I needed to be a representative payee. They couldn't discuss his benefits with me simply because I'm his wife. So, I informed them, and guess what, December 3 came around and they tried to deposit his check. Fortunately, our ducks were in a row with our bank and I was authorized to close the account that the money was deposited to as my husband had me added just for this purpose. Therefore, the money was sent back to SSA.
However, now, my husband has gotten a collection notice from SSA that they overpaid in December. I call the billing people to tell them 1. He's incarcerated. 2. The money was sent back to SSA in December as evidenced by the 1099 that was sent. They told me they couldn't discuss the bill with me as I wasn't designated as his representative payee. So, now, we'll have to wait until my husband is released and when he visits SSA with his release papers, he'll have to get the mess straightened out.
So, the moral of this whole odyssey with Social Security. If you collect either Social Security Retirement, Disability, or SSI and you have a case pending where you could face prison time, make sure that you have someone trusted to be your representative payee. This way, they can handle the rest of your affairs with SSA once you are taken into custody.

Unfortunately he is ineligible for inpatient and outpatient care meaning the VA will not supply his meds while incarcerated.
I was told simply informing his legal team before he went into custody that I was able to deal with his affairs would have sufficed but its not something you think about until you're cussing at yourself!
My mom jokingly asks me if I've been incarcerated, I guess she has to fill out paperwork through out the year.
when i was in the jail i had my mom do this with my bank account to give her control of it, they gave her papers for me to sign and during visit the counselor gave me the papers and i sign and she notarized and my mom then had and still has control over my bank account
