My son is awaiting trial, which is supposed to take place this month. My son has plead not guilty and told his lawyer he does not intend to take a plea bargain. He insists he's innocent of the charges against him and is willing to go to trial and face a jury. He is charged with sex abuse of a minor.
He has paid $12,000 to his lawyer since march of this year, but still has questions about just what the lawyer has done. He asked his lawyer for a list of motions filed and services performed, so he can be clear on where he stands moneywise so far.
His lawyer answered that he doesn't provide detailed invoices and doesn't charge by the hour. He charges a flat fee. He told him that he has gotten the prosecutor to agree to postpone the trial once and to eliminate one witness as unreliable. There is still another supposed witness, though.
With the trial coming up this month, the lawyer has not told my son to get a psycho-sexual test, take a polygraph, coached him on how to answer questions on the witness stand, or told him anything about what expert witnesses he plans to use.
When my son asked him for a list of services performed, the lawyer's response was, I don't do that and if you are not satisfied with my work, I will be happy to drop you as a client.
I feel this is very questionable business practice, but maybe this is how all criminal lawyers operate. My son has more confidence in the guy than I do. I admit I'm pretty cynical about lawyers, especially after reading some of the comments on this forum.
Any feedback you can offer will be greatly appreciated.

- Postponed the trial pending the outcome of another issue
- Eliminated all parents, investigators, and DHS workers as witnesses.
- Eliminated 1 child with false allegations as a witness because they are too young (another child with false allegations remains)
- Communicated with the prosecutor numerous times.
- Communicated with the investigator numerous times.
- Communicated and met with me numerous times.
- Looked over discovery (in what depth I'm not sure)
Otherwise I'm not sure what he's done. I don't know the value of these things. I've not been through this before.
I really hink it helped as we got a hung jury.
In our case (again we had a public defender..2 actually) I asked if there was anything we could do. I was told write down everything. Anything I could remember, any discrepencies, whatever.
Well, we got acopy of the petition (I guess it was) from the DA asking that certain evidence not be allowed because it was irrelevant or put it under the Rape Shield.
Well, I wrote (to his PD) that most of it was relevant because it showed a revenge motive...and also posed the question as to what child molestor is going to send (the child they're molesting) to a police station to answer questions about being molested by another person?
See, my step-daughter had been molested by a 23 yr.old when she was 13....he admitted to it ,and had a record of 2 other girls of similar age, one of which he got pregnant. Anyway, my S-d thought she was "in love with him" would try to call him after the police told her not to..wrote in her diary that she wanted to live with her Aunt and Unlce cos they treat her like an adult.... the umm.."meetings" took place in their home. And a whole bunch of other stuff.
Well, it was kept in...alot of other stuff wasn't allowed...but just that one episode puts alot of doubt in peoples minds.
Cos, funny but in 3 sessions at the police station (my hubby is the one who reported it) she never mentioned any abuse by her dad and he showed no hesitation in calling the police.
My point is, sometimes, you gotta gently push, you have right to know what's going on, and your lawyer shouldn't get mad.

Oklahoma will not register anyone past November 1, 1989 due to Ex post facto, Due Process, Equal protection and Privileges and Immunities.
Even if a state has a clause for out of state offenders. It can be won if an individual was convicted BEFORE a states implementation of their SORA. Regardless where the individual was convicted.
