Yay! Although I'd prefer they just remove him vs. making him petition (another) court who could find an excuse for why he's dangerous.

Those arguments hold true for so many of us..

These decisions are great and they keep happening - it is slow going but every time a judge declares (especially great when the Supreme courts of states do it) that the registry IS punitive and therefore cannot be applied retroactively it is only a short leap to since the registry IS punitive it cannot be applied to anyone unless it IS part of their actual sentence. No one (as far as I know) that is on the registry right now has ever had registration as part of their actual sentence -

In fact, many years ago when the question was before the US Supreme court they actually ruled that the registry was NOT punishment that it was civil (it was much different then) - so when it finally comes before them again and I believe with all my heart it will I cannot see how they can still say it is not additional punishment. That will be a great day for many reasons!

i'm definitely what you would call bias.... but any time you label someone and F up the entire rest of their life, after they have served their time and probation is punitive.

Very very happy for the state of New Hampshire. That is why I have said stay out of the middle of the country live in the NE or the NW. Completely agree advocate! We will never get the legislature on our side and pass reasonable laws in regards to RSOs, the only people that can help and may be willing to help are the courts. This is a great precedent for us, every little bit helps.
