@WorriedSickMD: I’m not sure what your husband’s exact situation is, but I went and saw a licensed sex treatment provider before being sentenced for possession of child pornography. It’s not clear how much an evaluation from a specialist can help your case—nobody knows what weight a judge will put in the testimony of an expert—but I know that seeing a therapist helped me personally. The right therapist can provide you and your husband with useful information and the support you need to get through this hell.

Regarding your cooperation with police:

When I was interviewed by the FBI prior to my conviction, I was told that my cooperation would be beneficial to me. This is a crock. According to the Federal Sentencing Guidelines, cooperation and the acceptance of responsibility can only decrease your sentence by around 10 months. The guidelines for child pornography are written in such a way that most defendants, regardless of criminal history, typically max out at the 20-year statutory sentence. 10 months for cooperation means little when you face a possible punishment of 20 years.

It was only until after I received the Presentence Report that I realized that all of the questions that the FBI asked me were specific to the child pornography guideline enhancements. Essentially, every question I answered only made it easier for them to tally up the score against me.

In my husband's case, the risk assesment helped, and my husband said while he was in jail, he saw people facing 100+years on their charges get reduced to 5 or 6 years after they completed their risk assessment. My husband's charge is a presumtive 5 year minimum, and it was aggravated (aggravated luring of a minor for sexual exploitation, class 2 felony) In my husband's first plea, they've offered to drop the aggravated (which would mean mandatory jail time of at least a year) and are offering 6 months in jail and probation. Now that they've agreed to drop the aggravated (so now its a class 3 instead of 2), our lawyer thinks they can work down to lowering charges, thus allowing him no jail time and probation only. 6 months is still quite a while (although 2 would be credited as time served). His risk level is low. The risk level is also used to determine what level of sex offender he would be if he had to register. So pretty much, if it goes well, it may help. Its all case by case. I feel that it should have been taken more into consideration in 5to20's case, but his charges were also on a federal level, so I'm guessing that might have something to do with the extremely harsh punishment, which still angers me by the way!
