my first thought for you situation would be get started on the paperwork for obtaining your husband's power of attorney.
You get the forms off the internet-- search for "power of attorney" and whatever state you live in.
also-- make sure its legal in both the state you live and whatever state your hubby is spending his time in.
The paperwork will have to be signed and notarised on both ends. Your husband should have a notary in prison somewhere---the prison deals with this everyday.
Once you have his power of attorney you can "deal" withe that PD and anyone with regards to his case.
my first would be the Pd...but if you can afford another attorney it could speed up the process.
If I provide a copy of this POA, his PD will have to provide all of that information? Just want to make sure.
I have talked to a couple of attorneys but neither of them will take the case until they have the transcripts to review his case. I want to start getting the ball rolling, because the trial transcripts wont be ready for another month.
Definitely include a copy of your poa with your certified letter to Mr. PD demanding your access to all pertinent transcripts documents ext.Also send this so the receiving has to sign for it and you get a receipt back showing date and the signature of the person receiving this. You may need this proof if they start the delay game against you.
