What can I do first can the parole agent change the release papers orders? He had 2 mo house arrest his length of parole is 24 mo he made it to house arrest for the entire 24 mo first they had a small band on his leg 7 months no violations new po agent new GPS on his leg that won't fit under his chief work pants it beeps and talks loud soon will probly will loose his job how can I stop this change the parole bored had him under house arrest for 2 mo how can they auto cha ge it can I appeal this ..Will it make them find fault? Helpcan I get anything changed

So, it sounds as if your son had what looked like a livable plan: 24 months of parole, of which 2 months was house arrest. This allowed him to get a job. (As a chef?) But 7 months in the parole officer has—without cause—altered the plan, turning the whole 24 months into house arrest and requiring that your son wear a large, noisy GPS device that's difficult to hide. So now he can't hold his job... Something that PO's usually hold against parolees. Is that right?

So the question is: is there any way you can fight back against this arbitrary change? Many people here have complained about the power of parole officers, but does it extend to making changes to the nature of the parole without reason?

Yes is it the right of an parole officer to change the orders he said that it must have been a type error that everyone has 24 mo house arrest that has a sex charge is automatic ly on an monitor the 24 mo .but our new parole agent the he has now 4 weeks in changes his ankle monitor he had on that tracked when he left and returned apparently is not good enough for them.so they took that on off putting on a GPS monitor on him telling us not to worry we wont incur any charges' for the devise and that this was not anything that he did wrong this is for him to keep track better we live in I'll

i honestly feel that this is a question that is better asked of a lawyer. to my own thinking, i would think/believe that the PO can not simply or totally change the written rules that are so different from his release papers.

If I might chime in here -- if the order from the COURT was 24 months of parole with two years of that time on house arrest, then that is what the parole officer must abide by without obtaining a court order counteracting the original order. The parole officer has no authority to arbitrarily change court orders.

Now, that said, there are many who have learned that parole official do as they damn well please no matter how illegal or unlawful it is, and to challenge them risks retaliation. The intimidation factor is what they use and depend upon to control parolee's.

So, he has to decide what he wants to do. He can and most certainly should speak with an attorney who is in the local area to see what the attorney has to say. If the attorney says the parole officer is nuts then he must decide if he wants to challenge the parole officer.

Experience has taught me that those in government WILL violate any law they damn well please and claim right to do so. They do this because they know they have the upper hand and the ability to simply ship the person off to jail or prison. And they WILL continue to do this as long as folks choose to live in fear of the jerks in government who violate the law.

Bottom line is -- how badly does the person you are involved with want freedom and what are they willing to do to ensure they have their freedom????? Its a decision only they can make.
