He can appeal the decision of his PO in the administrative process that should be available in that office and your state. It is a way to appeal a decision that a PO has made.
If you two are running a business together and the only reason that you can't do that productively is because of a PO permission, and the therapist has signed off on you, then it is time to possibly try to push a little on the agent... but it can't be you that does it, it has to be him. if you try, it will look bad for him and might cause more trouble.
So sorry that you have to deal with this...
I didn't mention this last time because the PO acknowledged the marriage but one thing you mentioned before was that the PO "felt" that because your SO was appealing his case he should be on SOISP. A PO's 'feelings' usually aren't enough to place someone on SOISP especially without any prior indication it was necessary like a probation violation. SOISP is a sentencing provision and is mandatory for certain sex offenses for 10 or 20 years depending on the offense.
If your SO was not sentenced for an offense that requires SOISP and SOISP was not ordered by the judge during sentencing he probably cannot be placed on SOISP on the whim of a PO without due process and there might be an administrative remedy.
On the other hand if SOISP was ordered by the judge or is required by the offense I'm not sure what to try next.
If you require your partner to run a business and cannot do so without him, then your rights may be violated and you really should consult an attorney in your local area. Keep this in mind
Not too long ago, my roommate's probation officer came to visit him and in the course of doing so, wanted to speak with those living in the house. I was volunteered. The probation officer demanded my personal info, i.e. date of birth, to run a background check on me and threatened to remove me from the house if I did not give my personal info on the claim that because the roommate signed some agreement to disclose who lives in his house, it somehow waived my legal rights.
When I spoke with the probation officer's supervisor and pointed out the errors and false claims made by this probation officer, the supervisor agreed with me. The fact my roommate is on probation and the fact he signed some agreement does not and did not waive any of my legal rights because the roommate has no authority to waive my rights and the probation officer cannot claim such.
Now, the probation officer could remove the roommate from the house, but they had absolutely no legal right or authority to evict me, nor did they have any legal right to claim my rights were waived by the roommate as a result of singing some agreement to disclose who lived in the house. Hence, merely because the roommate is on probation does not mean I loose my rights, because I do not and I have more rights than my roommate because he is on probation
Any one have any idea why the poly 2 hours was focused on me? He passed the stuff about probation and his offense... Is this just what they have to make it hard?
I agree that it is unfair, irritating, frustrating and deflating, learning that the justice system has nothing to do with justice and the Department of corrections is nothing more than a department of corruption. Where they say they are there to rehabilitate along with incarcerate even though most times no rehabilitation occurs both inside prison or after release. I firmly believe that the support system of an offender has far more to do with their rehabilitation in today's world than anything the state or federal systems provide.
