I just had a friend whose son was incarcerated in Utah and she lives in Iowa. She was willing to let him move in with her just like you, and had someone that would give him a job, but both states denied the transfer while was till on paper. I'm not sure if that is how it works in all cases or not. His were state charges.

He can submit an application for what is called an interstate compact. It essentially puts the DOC staffs of both states in communication with each other to determine whether they will approve the transfer. Each case is reviewed independently, and it essentially requires the proper alignment of stars to happen.

The risk that you have to consider, obviously, is if you have moved there and he is then denied a transfer.

Thanks.. I know there is a risk and I'm trying to deal with what would happen if it was denied. I think I finally found another lawyer. We like ours but as son as my son went in his lawyer figured he was done. It's really hard finding a lawyer who will take on extras after someone is in the joint.
I'm waiting to see if he takes the case and hoping that he will be able to help out with this issue. From everything I've read.. except here, these transfers happen all the time. My son is in low and the judge even agreed that he need not take sex offender treatment (altho one of his documents says he does.. another thing I'm trying to fix) . Philly is pretty liberal . .I'm more worried about Florida letting him go.
If he has a job up there and a place to live and me, his mom and nothing in Florida it seems only reasonable.. but there's a word they don't have in their dictionary - reasonable.

I think you hit the nail on the head - when it comes to RSO's, states (particularly Florida who has such harsh laws that most RSO's want to leave for other states with less stringent laws) want to hang on to us as we are a no-cost revenue stream for them.

Remember, you're talking about a state who forces people to live under bridges (I'm sure you're familiar with the Julia Tuttle Causeway situation) and on street corners as their registered residence. I don't think I'd count on them to look at what seems reasonable. Once again - you hit the nail on the head.

I would suggest talking to someone in the DOC with Florida who handles approval of IC's and explain your situation to them. They would probably be open with you about the chances of him getting approved. Just explain the huge risk you are taking and explain that you feel you would both be more stable in Philly because you have a network of contacts there (if not other family and friends as well).

I'd be moving there about 9 months before his release. So it would be put in as me, a relative living in another state and he has nothing here. I never thought they would put him in prison to start with. our attorney is still shocked by it as well. He says he thinks about it almost daily.
I could call anonimously to talk with someone.. I think I'll do that. Not sure who to talk with yet and if they will even answer their phone.
