My youngest son (37 years old) was arrested and plead guilty to possession and distribution of child pornography, was released on bail until sentencing on May 1st, then last week he was re-arrested. He now also faces charges in Montana. He goes for sentencing here on May 1st, then back to court here on May 8th regarding the same charges in Montana. There is a real strong possibility he will be sent there to face charges. Apparently any state in which anyone he had internet contact with resides can file charges and extradite him. I feel sickened by what he has done, but at the same time he is my child (and my youngest at that). I have to stand by him. I just wish I could go to Montana with him, but that is not possible. He will also most likely wind up serving his sentence(s) in North Carolina, too far for me to visit on a regular basis. He has to be in a medical facility due to medical issues. He has emphysema and marfans syndrome. And through all of this, I was diagnosed with stage 2 lung cancer and emphysema. I am scared for him and don't know what to expect or how to get through all of this. Any incite would be greatly appreciated, but just being able to post this I think has helped a little bit.

My son was convicted of the same thing here in MD and was sentenced to a 5 yr, all suspended but 1yr sentence with 5 yr probation. He's almost halfway done his probation and is doing fine. Just wish he didn't have 25 yrs on the registry. It's hard but you and he can get through it.

Thank you both for your support. To klw9653, per his attorney he will serve some time. The minimum sentence will be 5 years, but that's for his charges in New York State, he is also facing the same charges in Montana. But you have given me something to hope for, I will know what his sentence here will be this Thursday. I am also hoping against hope that Montana decides to let NY handle it, and not request extradition.

My son is doing time for the same thing. I think the only difference was his was pictures only, no live victim on the computer. He is 31 and had 10 total counts...5 f'2's and 5 f4's for child porn. He ended up with 3 yrs time, 5 years probation, and 25 years on the sex offender registery! He is still at the reception center waiting to be sent to whatever prison he will be at. Your son will be okay if he shows respect to those around him, keeps his mouth shut about his charges and just isn't a trouble maker in general. I believe they can also get time off for early behavior or for attending different classes while in, but not entirely sure yet. Take care and just keep encouraging him.

bsmom14, thank you. To correct something, my son had pictures and videos on his computer, he never had any live contact. Montana comes in to play because of a "board" he joined, he would share pictures an videos on the board. Apparently someone in Montana was also a member of the same board, so when Montana was doing their investigation my sons email address came up. As far as how much time he will get, his attorney said it depends on how many images are on his computer, the more images, the longer the sentence. Lets just say, he had been downloading the pictures for about 15 years (no one had a clue). He had them stored on his laptop, tablet, and at least 2 external hard drives. He was already told by his lawyer to keep his mouth shut about his charges and he will be fine. I know he won't make trouble. My biggest concern is his medical and food issues.
