Mental Health and the Registry

Hi, With my weekly trips to the jail to visit my son who is a SO, I've met a couple who's son is could be deemed mentally incompetent to stand trial and instead of going to prison, may be sent to a mental institution in Montana. His mom asked if I could ask you here if he will still be required to register when he is released from the mental institution in a few years. I would imagine he would have to as he is a SO regardless, but I wasn't sure so I told her I would ask to see what y'all have to say. Thank you!

Wow how awful that must be - all of this is terrible without the added pain of a mental illness. I am sorry I do not know the answer but I would think it would be yes unless they can get a judge to intervene somehow. I know a gentleman here in FL that I have known from way back before my son was even born - he is developmentally slow (but highly functional in society) but he got arrested several years ago and he is on the registry. He moved to another part of FL but I think of him often and wonder how he takes care of all the crap ....

Thank you for answering. That was kind of my thought too. I will let them know. They probably should ask probation/parole when the time comes. From being in this site and gaining more knowledge, it doesn't seem anyone is immune from the registry.

The most likely answer is yes, as state laws do not typically make exceptions for those who are adjudged incapacitated.

I am in Idaho and I know a young man (in his 30's) that is on the registry. He is functional but he is mentally handicapped. He really can't function all by himself, he understands money but only to the extent that if he has it, it is fun to spend. He wants friends so bad, he will do whatever someone asks if they promise to be his friend. When he was charged he had a public defender & ended up spending 10 years in prison and he said all he did was kiss an underage girl while at a party. He is living with someone that has managed to get him on disability & he gets money from the state to help some, before moving in with these people he was living at the local Lighthouse Mission. He is a very nice young man and very polite.

I guess what I am trying to say is that the chances are pretty good he will end up on the registry - unless an agreement can be made in the court to keep him off.
