I say that only half-sarcasticly.
But it's not appropriate. I'm sure, however, if you try to use it to change the custody arrangements you dig yourself a deeper hole because your fiancé is a SO.
You see putting a child in danger will usually trump all of those custody things and they if an investigation yields the information that was shown to your child then 'the system' will do the rest.
Your fiance being an SO could be brought up but if there isn't anything to bring up other than his past, then it will all be hot air.
But before all else, have a good long talk with your 12 yr old and discuss what they saw, what it is about, their feelings and things... Remember the commercial that they never play anymore... "The more you know..." Knowledge is power, educate your child and you won't have anything to worry about... even if you have to educate earlier than you ever planned on. Eventually we all end up being faced with things before we are ready... This is just another of those times.
Whether or not it was appropriate to share that information with a 12 year old is going to be open to serious debate. On one hand there are graphic details that normally wouldn't be appropriate but on the other your ex will claim he felt it was necessary to inform his daughter so she would be aware of what to watch out for to protect herself which many would see as appropriate.
It all depends on how far you want to go with this. At the least talk to an attorney. You can google your states statutes. Look under crimes against children.

Our CPS wont take a case unless it is extreme abuse. You can call them and report the incident. I go back to document.....they have no choice but to write a report. More ammo!
Now you have a choice. How far do you want to push it. What is your goal. Do you want justice as in prosecuting or do you want a say so in custody?
And then it wouldnt hurt to get a therapists point of view and reccomendation. Can i say more ammo?
We will go back to where you want this to go and how this has affected your daughter. This is cruel. This is involving children into adult issues. This is wrong.
In addition with all this ammo you have the best course of action is the court where your family case went through. Family judges have so much more discretion and will weigh their decisions on documention which you will have. Only you know where you want to go. I wish you the best.
