The charging state owns your probation. The state you move to owns your supervision. The state your moving to can add conditions but cannot remove anything.

Hmmm, odd they told me different... I'll have to check... So who could in essence remove conditions?

I am not sure about this - I know others on the site have dealt with these things. I only know of one person that I met that had been adjudicated in TX and then moved to FL. He was under TX probation rules and because of that he did not have to wear an ankle monitor etc. even though everyone in FL does.

I think the judge in the charging state would be the one who can change the conditions but it's such a mess. Do you have an attorney?

Yes I do but he sucks, a waste of money. I think it's going to come down to the po and proving that I'm not a partier, drug user (easy in both cases) etc and I'm a caretaker for my wife who's terminally ill and permently disabled and we have a business which we run out of our house and we pretty much go nowhere. The only issue will be Internet for business use.

@frogpond1 - You don't have to do anything for the transfer the PO in the sentencing state will submit everything for the compact then you just have to wait for the receiving state to accept it. Once they do you'll be given a travel permit to return home and reporting instructions on when and where to meet the PO in the receiving state.

The sentencing state is going to give you conditions of probation which you have to follow. This is where it gets confusing - the receiving state doesn't have to follow those conditions and can impose their own BUT you still have to follow the sentencing state's conditions in addition to anything the receiving state adds otherwise you can be violated.

In practice if the receiving state isn't monitoring a condition imposed by the sentencing state the odds of getting violated for that condition are very slim but do be aware it could still happen. As an example Florida usually imposes driving restrictions like you can't drive alone and have to maintain a driving log. If you transfer out of Florida most receiving states won't impose those conditions so you could drive alone and not keep a driving log but Florida could still violate you for not complying with those conditions.

I did read that alladin. It's interesting because the po in the receiving state could become more lax over time and allow things the sending state didn't allow. Question becomes will the sending state really check up on these things?

The thing about it is.. they don't even know what to do.

When I took my son out of Floriduh I emailed the police station to make sure he wouldn't have to register there before coming in Philly and I got an email back so I have it in writing. Get everything you need in writing if you can.

The PO's cannot speak to each other and must use the compact to communicate. 3 times my PO tried to contact my charging state and they took the full 3 month before replying.Next month is the 3rd month of my last attempt.... I am not hopeful....

I'm in my 7th year of a 4yr minimum - 5 yr maximum probation (or until further order of the court.) I have a 10 year registration requirement AFTER my probation ends..

Wait so you only have five and it's been kept going? I would think they wouldn't even bother after year five

You are correct Frog except up north it's $15/month supervision fees and registration is free. In the south it's $20/week and $150/year registration...

@Frogpond - The sending state gets status updates from the receiving state and that's usually as far as it goes so no they probably won't check up on things but it is possible. I wouldn't worry about it too much because the conditions for both states are probably going to be very similar. It's really when you're going from an extremely restrictive state like Florida to a more lax state that you have be more careful because the really restrictive states tend to follow up more.

@FreeToBreathe - Is the sending state refusing to terminate your probation for some reason or do you have to petition the court to terminate it? If had completed the full sentence over a year ago I would definitely be filing something with the sentencing court by now seeking a court order acknowledging to termination of probation

@aladdin The thing is the sending states terms can't be changed so for example if say a certain amount of time in the po here decides that he wants to let me have more things he can't. Or if my wife dies and I now need a smart phone to run the business and computer I'll be waiting for ever for any type of change and in the meantime we go out of business.
