Usually there is some catch phrase in the sentencing documents that includes this or they can say includes this. I don't think they will allow you to complete treatment without a full sexual history polygraph.

Yeah I think my paperwork said something like whatever my PO deemed necessary. PO's are given carte blanche to do whatever it is the feel necessary to "rehabilitate" a sex offender. They are given way too much power with not many checks and balances -- as the old saying goes absolute power corrupts absolutely.

The state of Ohio doesn't use a polygraph that I know of? The assessment is just a video recorded session with a "licensed Sex Offender therapist". It takes less than an hour and can be done on a walk in basis. Looking at the sentencing paperwork it does list "supervisor under a PO with any terms they deem appropriate". But the PO is stating that it is required by the judge in the sentencing. He has also stated that he will remove the no contact with minors unrelated to him if the therapist says it is unnecessary and that he will removed the "sex offender therapy" requirement if the state approved therapist says it is unnecessary. The PO swears that he doesn't want to exacerbate my husband's mental conditions or to cause any undue strife for our family. I guess all we can do is call him and let me know that it is so far beyond our means right now. We are only going to have christmas gifts for the kids because of the kindness and generosity of our church. The thought of him going back to jail and being gone longer for something completely out of our control is just scary. So scary.

Yeah he needs to call his PO and ask if there is any way to get a sponsorship or financing from the state on this. That's about all you can do, I might also ask the RSOL affiliate in Ohio if they know of any other way to get this taken care of.

Thank you. I appreciate it. We've had problems with the county where he was charged and sentenced from the start. They are terrible about accuracy or, well, the law. They held my husband an additional day because they said that he needed to register in the county of the offense and the SOR Officer had placed a hold on his release until he registered (and she was the only one who could do it, supposedly) and then she went on vacation two days before he was set to be released. I drove 45 mins to find out that he was being held for no real reason. And with him being set for release on a Sunday morning, they would not call anyone for clarification to see if there had been a mistake. They did not even admit their mistake until the day after he was released. Two days after the fact. There was tons of finger pointing and blaming going on. My husband self harms and has suicidal thoughts and their version of a mental health assessment was to send someone in to stare at him and ask "you wouldn't really kill yourself would you?" They misplaced his power of attorney paperwork for me for over a week. Then told me it had been in the folder at the desk for the officer on duty this whole time. It's just a county jail but they can barely handle their jobs. When he went to register in the county we live in, it was easy as 123 to get it done, they treated him with respect told him everything that he could expect from them and they were respectful and appropriate when they came out to verify the address and so on. Very professional and appropriate. The county where he was charged. . . lies, mistakes and drama from the moment their detectives showed up at my door.

We got a call from the therapist we spoke to the other day. She wanted to know why the PO was asking for an assessment that does not meet the correct procedure for the crime. She said that the assessment he asked for is too much for the crime and that it would in no way be accurate as the assessment is for SO's who have had forced physical contact with their victim. Not SO's with photograph only charges. She wants us to have the PO call her so she can get it ironed out with him and get things moving. She says that the appropriate counseling and everything for this level of issue is all going to be covered by our insurance and that the assessment the PO wants is ONLY to be given if it is court ordered (there is not a court order on file, she looked) AND the State is to pay for those assessments in full. The counselor is one of the top 5 SO counselors approved by the State of Ohio but the PO is the head of SO Probation for the county of the offense. Why does this all have to be so confusing and conflicted? It's such a mess but I have hope that we may have an ally in this doctor and maybe that will be a help in our situation.
