so my husband had court last mouth on the 12th his PD said she needed an extension because she needed more time to go over the discovery with him well anyway he hasn't seen her at all he called her today and got ahold of her and I called her as well she called me back and was like she is going to try and go see him tomorrow (Thursday) anyway nothing has happend because the prosacuters office has to speak with the victum my daughter his step my question is what kind of things will they ask I am hoping tat between his pd and the prosacuters we can get a date for her to talk to them should I allow that she tells me that she doesn't hate him and that she doesn't want him to do any jail time so I don't know also my dyfus worker wants to go and speak to him the first one did already why do they need to go again I don't know I don't even know what to expect on Friday oh and another thing when he was in the holding cell at the court house the CO or the sheriff that was in there with him and 2 other guys threated them made them look him dead in the eye and threanted to kill them on the streets if he ever saw them

Well your story hits very close to home. being almost the same situation. So as long as your daughter is careful with how she words things then things will be ok. If he did in fact do something to her then he will serve time, but if he didnt she needs to tell them that. How old is your daughter? Because at a certain age they will put the victim on the stand and if she says he did nothing on the stand they will have a very hard time convicting him.
As far as him being threatened, that is A HATE CRIME. Hate crimes are against the law and is punishable in court

Hopefully the DA will listen to what your daughter wanted, and be able to work out a plea deal to avoid putting her through the trauma of testifying. Also let his PD know this too, I'd they are truely working for him, then they can use this knoweldge to leverage a plea deal....good luck

Scaremoman, I am in the same boat just like you. My husband is in the county jail. His last court date was on the 8th. His attorney was able to get some of his charges dropped, however there is about 6 charges left I think. I'm not so sure anymore. There is a plea deal in the works but I haven't been able to get a hold of his attorney since the last court date. I have asked my daughter (his step ) how she feels about him and she says that she is not mad at him. That he is not a bad man, but a good person who made a bad choice. I believe that she does not want to testify against but just wants to move forward. His attorney has said that a she should talk to the DA and tell her that and many other things, in the hopes of getting of a lighter sentence ( his attorney said that one of charges says he can get a lifetime sentence ( ca state)).. I hope we can move forward soon. My husband has been In county jail since June. I left California , and moved to hawaii for support. I now have become a mother of 4. I hope and pray that this gets resolved soon and that we can become a family again. It seems that hawaii has less restrictions than what CA has.

@h3lpm3 how old is your daughter she seems wiser than 95 percent of the people that we have in the government. I know this by her statement that says he's not a bad man, but a good person who made a bad choice.
