My husband was sentenced to 60 months jail time, 10 years supervised release, and 40 hours of community service. They took him into custody immediately and I'm not even sure where he is. A judge mentioned a place that he thought he would be going to, totally different place then where we were told he would go to, so really have no clue where he is. This is just a temporary location and I really have no clue how to find out where he is. Today was a total nightmare. The judge was a complete joke. I believe he knew before we even walked in there on what his sentencing would be. What gets me is he had his assistant contact our lawyer yesterday saying that they wanted everything wrapped up in under an hour, this included the change of plea hearing along with the sentencing. Because of that we didn't do live testimony, doubt it would have done any good anyway. However, the judge made us sit through over 45 minutes of him stating his position on the The Sentencing Commissions Report on CP that came out the other day. Except for the fact my husband was being charged with CP possession, it had nothing to do with my husband's case. It almost seemed like he used my husband's sentencing hearing to have his opinion about the report put on record.
by the way...what was the judges opinion on the ussc report? just curious...my sons judge didnt say diddly squat...just the sentence.
From federal court ( and his lawyer ) my fiance managed to get three years for just possession. Child pornography laws are all messed up, while talking with his lawyer we were told you can get more time for viewing rather than making. She had a case where the person did get more time for distribution and possession rather than creating the pornography. So, the laws are all messed up in general, never really understood alot of the things the government as set up. This is also from the federal court of Wisconsin as well..
In terms of the actual transfer process it really depends on a lot of circumstances. On one occasion my husband was going from southern Minnesota to Milan, Michigan but got bussed to Terre Haute where he was kept in the middle of summer in the old death row (no a/c and a very old building) for over two weeks before being put on another bus back to Chicago and then on a plain that flew RIGHT back to southern Minnesota where they picked up a bunch of other people - flew to South Dakota, then to Kansas City, MO and finally on to Oklahoma City where they have a huge federal transfer center at the airport. He was stuck there for another month and then finally flown to Michigan.
It was crazy - but that's how the feds work.
I'm sorry to hear about his sentence but I would like to add if he was convicted in Federal court he has to
Serve 85% of his 5yrs, which would be 4.25yrs,unless the Feds change that.
I know u think its a long long time, but u are really lucky. My son was convicted on the SAME charge, and got 15 yrs. !!
As far as not knowing where he is, just try to remain calm...it does take time.Again, if this federal, u can go on the FBOP - Ferderl Bureau of Prisons, and do an inmate search for him -once he gets to where he is going to satyr for awhile, it will tell you on the website. He probably will get to call u briefly when he
gets there. Also, once he is there, his contact with u for the first month (no visits) and limited contact. According to FBOP, this helps them acclimate to their new rountine. Sounds like another chunk of BS the Feds feed us everyday regarding our loved ones.
