ok, I am going to say it again... and ask this question... if the prosecution doesn't have much and they say they aren't looking for jail time, then why are they charging him at all? Also if you plea you ADMIT GUILT if you are guilty that is one thing but if you are not why would you say you did it if you didn't?

I know what you are going through... I lived it... twice... once before an appeal and once after an appeal... I know what they are asking... and I would question your defense lawyer that is so quick and anxious to send you down the river.

Joansalmon, no one knows that they won't have jail time. First of all, the plea agreement is between the prosecution and the defense. The Judge can still do whatever he wants. Even if both say no jail or less jail or whatever that judge can change the outcome. that is their power.

The media will pick up a story from the time the person is arrested to their sentencing. So since the media hasn't picked up on it yet then it could be only a matter of time... or they could ignore you entirely, just depends on what else is going on for them to report about.

Remember a plea agreement is a really easy case for a lawyer... they have to fill out a form and the bill you thousands... Trials are hard, require time and money and the less a lawyer does the more profit they make. Don't forget this is their profession, what puts food on the table and luxury cars in the driveway, they want to maximize profits and work as little as possible... why do you think that they have dreamed up this so-called plea agreements? to reduce the amount of cases taken to trial? no TO MAKE MONEY.

it is sad.... my husband's first plea was for 3 yrs incarceration and 5 extended supervision... the judge gave him 10 years incarceration and 5 years extended supervision... cause the judge was having a shitty day he was cranky and took it out on my man...

after the appeal was won, we had to go back and we tried everything and again were stuck with the damned plea deal... this time 5 years in and 3 extended supervision I think is what it was... super shitty... the judge gave him 4 years incarceration with 2years already served and 6 years extended supervision... better than it was but NO where CLOSE to the agreement...

So just because there is an agreement doesn't mean the judge can't do whatever the hell they like... It is a common misconception that people think that because there was a plea agreement that the judge will follow that... cause when it comes to sex cases. THEY DO NOT.

Thankfully the lady judge that saw my guy reduced his plea. She thought the sentence was ridiculous, but even so, he is gone for a year. Thankfully it was not the 18 months that he was bullied into taking. So sometimes it works in favor....although he should not have been there in the first place.

"he shouldn't have been there in the first place." is the point... I think that there is a great many that shouldn't have been criminally charged... Mainly because usually there was some other underlying emotional issue that caused the behavior in the first place.

This kind of behavior towards post-pubescent females and males comes from out human nature. You know, to perpetuate the species. It is hardwired into our brains to 'get with' and 'procreate' so that our species lives on. That is nature.

Now for those that prey on PRE-pubescent children, now they have bigger issues, sometimes they can be self-controlled and some probably have a very hard time with the urges. But from my reading and studying most of the time those urges are controllable if the person wants to. I also believe that a lot of these tendencies come from being victims in childhood themselves and 'learning' through example that it is "OK" to behave in that manner, when in society it is not.

I just wished we could have gotten that lite of a sentence my husband took a plea in 99 and got 10 years and served all 10 years, was home for a little over a year and was sent back because of a jerk saying that he was living somewhere he wasn't suppose to be. He wasn't even living at the address that the jerk said he was but they believed the jerk and he got another 4 years, he has been in since September and already been up for parole and was set off until next March. We are being hopeful that he will get to come home then but he isn't holding his breath he thinks he is going to have to serve his full 4 years. The county we live in is really hard on SO and if you take one wrong step they will pull your ass back in and there is nothing that you can do. I think it is funny though, the "Chief" that arrested him and filed the paper work on him and everything is now facing charges of misuse of items from the property room. He was fired from his job and the Texas Rangers are looking into it and there will probably be charges brought up on him. I think karma is a bitch.... what come around goes around and it is taking a big chunk out of his ass. There is a big chance that he is going to see what it is like from the other side of those bars!!!!!
