@Firecracker: Yes, the constitution says we have a right to a lawyer but most of us are not rich and get a PD who is not getting paid and who "really" doesn't give a chit about your rights. I know you already know this but rich people seldom do time because they can afford a good lawyer. If an attorney is getting paid well, he doesn't care what other people think. His pockets are full and he gets plenty more cases to keep filling them!

. The Fourth Amendment guards against searches, arrests, and seizures of property without a specific warrant or a "probable cause" to believe a crime has been committed. Some rights to privacy have been found in this amendment and others by the Supreme Court. The Fifth Amendment forbids trial for a major crime except after indictment by a grand jury; prohibits double jeopardy (repeated trials), except in certain very limited circumstances; forbids punishment without due process of law; and provides that an accused person may not be compelled to testify against himself (this is also known as "Taking the Fifth" or "Pleading the Fifth"). It also prohibits government from taking private property for public use without "just compensation", the basis of eminent domain oh and i forgot this one this one should get a laugh from everyone on this site The Constitution of the United States is the supreme law of the land in the United states of America.
I think the REAL question is this - out of the 2.7% who did commit a new sex offense how could a sex offender registry have every stopped them? It couldn't - IT DIDN'T! The registry only serves to make the lives of those who will NEVER commit another offense impossible to live in a healthy, law-abiding, and stable manner.
These laws are so absurd it would be laughable but for the fact that they are in fact COUNTERPRODUCTIVE to the very goal for which they stand - public safety. When will Americans pull their heads out of the sand and start listening to the experts on child and public safety? Even Patty Wetterling, the Minnesota mother of a 12 year old who was abducted and never seen again who was instrumental in getting our first registry enacted over 30 years ago, has publicly spoken out against these laws.
There IS a better solution - one that allows any person to obtain an application from someone who will become part of their family's inner-circle where the application authorizes that person to do a background search - the person doing the search could then obtain an authorization code from the registry for a look up on that individual. This takes the negatives away while leaving the positives. This solution would make our communities and our families safer. The public registry puts otherwise low-risk offenders at a higher risk for recidivism because it makes it impossible for them to rebuild any sense of normalcy in their lives.
And to the "Valerie Parkhursts" of the world, why do you insist on ignoring what child and public safety experts continue to say? Do you not care that these laws put our children at greater risk?
