Dear Friends of Galen, my letter will focus on two projects we did together while he was working for CURE as Director of Communications. They are (1) the trip we did to visit the CURE chapters in the Northeast. This was right after his father's tragic death. and (2) The Bangkok Conference where he was my right hand man to bringing it about. In fact, I don't think that I could have done it without his help.

Sadly my PO is doing his best to lock me up. We're asking people to send letters to my lawyer to give to the judge at the bond hearing. Here's the language my counsel is suggesting. They'd prefer we not make any public claims about the nature of the accusation, but have people read the probation violation report (attached). Thanks so much for your help with this, and feel free to edit what we've got to make it best fit what you were thinking.

Galen Baughman is a member of our community whose Soros Justice Fellowship focuses on challenging Virginia's system of indefinitely detaining people convicted of sexual offenses. Galen is also on probation in Virginia, and many of you have heard his story.
Yesterday Galen learned that Virginia is accusing him of a technical probation violation and the probation officer is asking the court to issue a bench warrant, hold him without bond, and ultimately revoke his probation and send him back to prison – all for a technical violation, without any evidence of criminal behavior or intent.
Galen is an upstanding member of our community and we need to send as many letters to the court as possible to help the judge understand why Galen should be released on bond immediately. The bond hearing will be this week, and it's important for as many supportive letters to be submitted prior to the bond hearing so Galen can get out and continue his work, while challenging this attempt by Virginia to silence him.
Here are some bullet points to aid you in writing letters in support for Galen for use at his bond and/or revocation hearing:
The letters should be addressed "Dear Judge Fiore" ( because the case will be heard by Jude Daniel Fiore of the Arlington County Circuit Court, 1425 N Courthouse Rd, Arlington, VA – Court House Metro Station is directly across the street)
Explain how you know Galen and what your relationship is.
Include any positive information about Galen's personal characteristics, professional achievements and goals, connections to the local community, etc. Where appropriate, include specific examples in addition to general statements.
Make clear in the letter that you are aware of the accusations against Galen based on the attached violation report. We are not looking for our letter writers to express opinions on the meritoriousness or lack thereof of the alleged violations at this time, but we do want to prevent the government from arguing that the letters should be given little weight because their authors were not being told all the facts.
Please send the letters to directly to Galen's local counsel, Charles Burnham <charles@burnhamgorokhov.com>, rather than to the Court and Galen's local counsel will submit them all at once to the judge. Thank you again for your help and support.

I want to personally thank everyone for being so incredibly supportive during this stressful time for me & those closest to me. There has been a truly heartwarming out-pouring of support in letters and calls. And I am confident and eager to get before the court and present a vigorous defense against Virginia's clear attempt to silence me.
There will be a Bond Hearing on Tuesday, April 26th at 9:30 am at the Arlington Courthouse (metro accessible via Courthouse Metro on Orange/Silver lines). I'm personally asking that as many who can personally make it to please come to show the Court that I have support in the community. My probation officer is asking that I be held without bond pending the violation hearing, which is beyond absurd. The state has no claim that I'm a danger to the public or that I'm a flight risk. Any attempt to imprison me prior to a hearing is merely designed to prevent me from being allowed to continue my work and contribute to my defense.
I'm including below an explanation from one of my attorney friends on how probation violations generally work, which might be helpful for some in understanding the both the situation I'm in facing the bond hearing and what we're looking for in letters right now.

I just wanted to take a moment to clarify a few things about where Galen is in the process and what might be useful to know when you’re considering whether to write a letter of support.
First, I want to make clear how probation violations work. Everyone who is on supervision has a set of rules they’ve agreed to abide by. These rules can include things like appearing at supervision appointments, getting urine tested, completing therapy, or avoiding contact with certain people, like other people with felony criminal records or people under the age of 18. You can be violated on your probation for either a law violation or a technical violation. A law violation is when the supervisee commits an act that would be criminalized for anyone. For law violations, supervisees are routinely sent back to jail (usually regardless of the amount of evidence against them, which is its own problem!).
A technical violation occurs when a supervisee breaks a rule of his supervision – something that wouldn’t be criminalized for other people, but is instead a violation of the set of rules a supervisee has agreed to. For technical violations, people are rarely sent back to jail. What usually happens is that the presence or absence of technical violations act as a plus or minus factor when determining the length of time that a supervisee will be sent back when they commit a law violation. However, that pattern doesn’t hold for people who have been convicted of certain types of crime, including sex offenses, intimate partner violence, and stalking.
Galen has been accused of a technical violation. But my understanding is that he’s not at the point of the process where the judge is making a ruling about the content of that charge. Instead, at this point the judge is just deciding whether he should have to stay in jail between now and when a hearing is held on the charge. My understanding is that in making that decision, the judge is supposed to consider only two things:
Whether the person poses a flight risk, and
Whether his liberty will constitute an unreasonable danger to himself or the public
Some of you may feel uncomfortable making any judgment about whether the case itself is one you support, especially because we don’t have all of the facts. But if you do feel comfortable writing a letter in support of Galen’s character so that the judge does not keep him in jail between now and the date of his hearing, that would still be immensely helpful to Galen.
I also wanted to clarify that a personal letter of support would be meaningful as well – it doesn’t need to be on organizational letterhead to impact the judge.
On a process note, Galen’s hearing has actually been pushed back – he’s going to self-surrender over the weekend, and the bond hearing will be early next week. If you can get a letter to his attorney by Sunday night, the 24th, it should still be useful in his hearing.

My own experience is that too often those in government abuse their title, position, or power to flex their muscle in order to silence someone. I have dealt with this far too often during the past six and a half years that I have been a guardian; using my ward as a pawn to try to silence my voice that calls them out on what they do. For someone like Galen, he is a prime target. He has a sex offense and is an advocate for the same class - two ingredients that make him a prime target for retaliation with purpose to silence his voice.
I have had the opportunity to speak with Galen only briefly on a couple of occasions, but I found him to be a dedicated person who truly wants to help those who do not have a voice, and, yet, are subjected to the severe abuses of power the state throws at them. I hope he is successful in defeating the state's effort to do the same to him.
It's a shame that his actions could set everyone back to square one.
This 'addiction' /attraction/ problem isn't simply I want "another drink' problem. It is a re-lapse that begins and ends with endangering not only ourselves but actual people/ real victims. Sex offender Relapse is not a mere exercise in technicalities or 'legalities, It's about self respect, self control and second chances and about real harms done or about to occur.
I know an alcoholic who said "I always know I have the possibility of taking off on another runner, but I have come to realize that I am running out of chances to make it back afterwards. " All of us on Daily Strength (whether family, friend, victim or 'registrant') are fallible and subject to participating in a 'runner' not because as the haters tell us we are (forever) scum but because we should know we are (forever) human and subject particular set of weaknesses.
Yet know we have been 'triggered' and then seeking help can be a catch 22: What if we are making progress and do not want to relapse (want to stop ourselves sliding further down an 'always present' slippery slope) where can we find real help that doesn't send us or our loved ones back to jail because we do not want to fall back but our first duty as adults is to still to protect underage kids?
Isn't that the spot Galen's friend Josh found himself in? And if the red flags are seen and heeded...how and where to find help before it all came down to this?
