Oh I know and I hear people say on TV all the time that an innocent person would never take a plea - absolutely not true! It happens all the time!

Pretty much everyone is forced to take a plea deal.

My guy could have pled guilty to a misdemeanor and get 12 months in jail, or make it a felony for 9 months. He plead guilty to the felony since the attorney said he could get it reduced to a misdemeanor later. How can one offense be both? Exactly! Everybody pleads out. It gets the DA a good conviction rate, and the "offender" less time. So screwed. Plea deals are not legal in Europe for a reason, and the trials would have to be more fair in that case.

The news should question the DA more about why they didn't drop the charges, as the evidence showed that he was innocent. They DA will try to convict everyo a, even when they know they are innocent.

Mtbfan, I don't think you man received good advice. Always take the misdemeanor, they don't even count, they are like parking tickets. There is no question on job applications asking if you have ever been convicted of a misdemeanor.

Well, he had another felony anyways, but the 2nd one gave him less time, which at the time was such a relief. If he had to do it over again, I think we would have gone with the misdemeanor. Lesson learned.

Sometimes job applications do ask about misdemeanors, though you don't see it as often as you do about felonies.
