Hello Everyone,
It's been a long time since we began this journey.....four years ago. My husband was accused of molesting a former student that he had many years ago. He maintains his innocence and I believe him. We have fought it for 4 years, and now after running out of all options (motions, etc.), our choice was to take the plea bargain (3 years with 50% off) or go to trial. Our attorney counseled us that our chances probably would not be that great if we went to trial as juries usually come down on the side of the alleged victim.
It was the hardest decision we've ever had to make, but we decided to take the plea bargain rather than risk that a jury would convict him for life. I am worried for the safety of my husband, how our two precious daughters and grandchildren will handle it, and selfishly I'm worried about myself.
One major thing that is worrying me at the moment is the news that the California legislature is considering taking away pensions for convicted sex offenders. I don't know what I would do financially if this were to happen.
and what about all those families out there that have small children at home?
I understand the public's anger at public employees receiving pensions after they go to prison, but I don't think they realize how much the families will suffer if this law passes.
What about the time that was put into the job before the accusation? Shouldn't public employees at least receive their pensions for that amount of time?
I am feeling very overwhelmed. My husband hasn't actually pled guilty yet. That will happen next week and then they give you 30 days to "get your affairs in order"...sounds like we're going to die!
Please help if you have any thoughts.

was your husband a teacher ? mine was he got his pension
The thing that scared me was as soon as he had pleaded guilty everybody seemed to know. The social services arrived on my doorstep the following day and now he has know contact with my daughter at all. Be prepared for this with your grandchildren if it isn't already the case. We go for sentencing on the 30th, with 2 weeks to go your right its like preparing for death...

There is something called a PCR (post conviction relief) What a PCR is, is a new trial if evidence were to be found to clear your husbands name. He wouldn't be able to file a PCR with taking a plea, because you first have to appeal your case, and then file a PCR. I would think LONG and HARD about taking a plea! It minimizes his options of EVER clearing his record!

My heart goes out to you. You have to make the decision. I just wanted you to understand what repercussions he will be facing if he takes a plea. Sometimes attorney's do not tell people what the outcomes are with plea deals, so people are blinded.
Ultimately, you have to go with what your heart tells you is best.
