http://www.cnn.com/2011/10/06/us/california-robbery-porn-bust/index.html?hpt=ju_c2 OK so these 2 guys break into this mans barn steals about 50 CD's which they thought were blank only to find out there was CP on it.so the police get a warrant and arrest the guy for CP somehow i think it may get thrown out because of the way the police got it.and of course all of the comments the people are on the side of the people who broke into this mans barn and stole his CD's some people are saying that they should be given Medal's and no jail time it just strikes me as strange when it come to a crime a sex crime people either wants to see someones life completely and utterly destroyed or they encourage vigilantism. i still think that people should get off of their lazy butts and watch THEIR kids instead of letting the government be a baby sitter please don't misunderstand me what i think this guy did was wrong he should not have had CP but those other guys broke into his home stole his property and went to the police with it will they prosecute those 2 for braking into this mans home? i doubt it but i think all a good lawyer has to do is tell a jury that the CP was illegally obtained by the police

If we apply The Rule of Law, all three should be held crminally culpable. The police can still use the evidence even though it was stolen becuase they, themselves, did not obtain such illegally. Assuming of course, the two who broke into the bard did not do so by being what is called a "state actor." This is to say, they did not do so by request, suggestion, or order of law enforcement to bypass having to get a warrant. If that is the case, then the case is thrown out for violating the 4th Amendment right against illegal search and seizure.

On a side note: Why is it that folks who stand up against for what is just and right have to always qualify their position by saying "don't get me wrong I think what the guy did is ...." It's like we have to qualify our statements to have them listend to so we, ourselves, are not branded as a child molester just because we disagree with what is going on.
