What I said before about Parole, stands the same for Probation...You need to have a cetified copy of the Judges order concerning terms of his probation, my PO came over and almost arrested me for having an after work beer, but I had the paperwork that said I was not alcohol prohibited.
Did you once say that you were going to get a duplex where your son would have one half and you the other? If that's the case, as long as there is not a connecting interior door between yours and his, they CANNOT search your house...
It's really not so bad as the media makes it out to be, as long as he does what he is supposed to do he shouldn't have problems.. His PO will come over at least once a month and may or may not search his place, a lot of it will depend on his attitude..If he has a good attitude and doesn't play bullshit with his PO(some PO's can be dicks just to be dicks but most want their people to succeed) he may even get his probation reduced....I had 3 yrs probation, my PO went personally to the Judge that sentenced me and I was released at 18 months(He was a good guy and I played it straight with him)...As much as it sucks, I did what had to be done, it wasn't easy, if you haven't noticed, I have a hard time "biting my Tongue" and it will be even harder on you because you did nothing wrong....
If you own guns and he is living in your house, even if he is off probation, as a felon he can(And probably will be) be charged...A felon cannot possess guns, even a bullet can get him 5 yrs....They can be locked up in a safe..It doesn't matter, he will be charged...Like i said, it sucks, you're just "Collateral" damage as far as the politicians are concerned.
I moved here because I thought they'd be busy with other crimes, as their funding isn't very good and they're short staffed. I don't own a gun but I have to take all our martial arts weapons and store them somewhere. which kindof sucks because some are mine and now I cant practice with them.
I know they can still keep him in Florida so that's another hurdle we're waiting on. He's got a job , a home and family waiting here in PA and nothing in Florida. So we wait. 6 months to go.
In Florida they tell my son that because he is adjudication withheld that when he is off probation he retains all of his civil rights including owning a gun. I know there is also some new law in Florida that allows convicted felons to ask for and receive (in some cases) their civil rights restored.
In Florida it is actually going to rest on the judge you get as far as whether he can leave the state or not. If the judge is human they will know that a stable home life is the best thing for him and the promise of a job is even better. Be advised that he will be on the Florida registry for life (until it changes someday) even if he moves. You also need to check with the local authorities in Fl and PA (?) and make sure you get details down to the letter about what they expect from your son and to follow the rules about moving there. I have seen people think they know what they are supposed to do to move and actually get arrested for violation upon arrival in the new place.
I'll have to check with the lawyer about the move. So far my son has given our Philly address to his counselor and we're waiting . The judge never noted where he should live when he gets released. There was a mention that he'd be in a prison not out of the state so he'd have family close enough to visit. I would think that when he goes to the cop shop to check in within 78 hours of release and then goes to his PO he'll have a list of rules from both. We already have a list from when he got sentenced. At this point I thought it was up to his counselor about the move out of state. Our attorney never mentioned that we'd have to petition the judge for anything.
Florida said they would give your son some of his civil rights back? I've never heard of that, like voting or owning a gun? They'll always be labeled SOs and to me that's the civil right problem. Getting off the list should be attainable, but it's not.
I guess I'll have to look into the search and seizure procedures they have up here.
Anyway, my son retains his civil rights because he was not convicted – he was adjudication withheld and as a youthful offender. As far as I can tell so far this ruling does not make a whole hell of a lot of difference as far as his SO status. He is still on for life etc. But he retains his civil rights – he voted in the last election. The gun owning part he can do after probation. I have been told that adjudication withheld is a good thing because he can later have the record expunged but I have never found any information to support that. But just in case that is why I counsel him not to do anything to jeopardize that status.
They're putting mini parks there so I doubt he'd be able to live there now.
My son is federal as well. So if the cops or Feds come to the house I'm not going to let them in. Or I can ask his PO when and if he gets up here.
It's so stressful. We don't even know the answers. If they were murderers they'd be able to live anywhere.
