the Sate would not accept his parole or the reason giving?
As far as residency restrictions, so far from what I can find, h has to be 1000' from any park, daycare, and secondary school.
I have not heard anything about churches, unless of course they run a daycare...
Also, I have been told by this person who contacted us, he ill not only have to abide by Indiana's rules ( if he does get paroled here), but also the state in which he was convicted (GA). WTH??? talk about setting someone up for failure!! My God, as if the rules don't change everyday...Sheesh!
The comment about having to abide by both IN and GA rules only applies to someone convicted of state charges wishing to transfer supervision via an interstate compact and does not apply to federal convictions. While there may be minor differences in supervision between federal districts by and large they're all the same because they're all federal and follow the exact same federal rules. You might want to talk to Nakohichi because her son was convicted on federal charges in FL, served his time in FL and yet she able to get him paroled directly to Pennsylvania.
It's odd to me that a federal PO would even mention anything like having to follow IN and GA rules. Usually federal PO's barely even know the Interstate Compact system exists because it doesn't apply to them. A federal conviction by definition means the defendant was not convicted under the jurisdiction of any state so state supervision rules can't apply. (Supervision rules only - residency restrictions are completely separate)
Thank you fo the clarification.
It is possible she ( The Federal Probation person), was referring to residency restrictions, since we were in discussion about our current home NOT being suitable for him to stay here, however, she didn't really say so.
I guess what threw us mostly was, he still has 6+yrs to go.
Oh, also, I have to add , he can't be 1000' of a public boating dock...for crying out loud...for real??
I guess its all those under-age boaters & fisher-persons! Wow!
