A month after meeting with CPS, my wife and I got a letter stating that 'there is a preponderance of evidence that your daughter has been offended and faces a high risk for sexual abuse.' This is nonsense. I have never laid a hand on my daughter, not even for a spanking. What really pisses me off is that CPS had my wife sign a document that stated she was concerned about legal matters. After she signed it, the CPS rep wrote in 'sexual abuse'! Now, it appears she is worried I would harm our child. We're going to try to call them on Monday, to get some explanation and plead our case.

I said nothing regarding my pending cp investigation during my CPS interview, so I don't know where the 'preponderance of evidence' comes from. My wife and I are utterly freaked out that we're being set up to look like worse parents than we are. I'm scared about losing my daughter, and am very reluctant to be involved any more with CPS.

Has anyone here had experience dealing with CPS, and if so, what advice can you provide?
Seems like a real tightrope.

The DA's office may have called them, which is why they showed up in the first place, if they wrote in sexual abuse after she signed the typed letter, it can easily be disputed. You also don't have to have an interview with CPS. You can decline meeting with them. They may go to your child's school to interview her, let your daughter know that she can't be interviewed without a parent present. So if they do show up, tell your daughter she won't speak to them without her mother there.

I always had a third party there with me whenever CPS showed up at my door (the prosecution and detectives trying to scare me into playing ball when I refused). After several interviews, and found no evidence that my children were at harm, they left me alone.

For the love of god do not call them if you have an attorney have them call do not deal with them on your own and document everything that is said use your cell phone record all conversations these people will manipulate lie and put words that where not there just to destroy you they are your enemy and should never be trusted

What I have been learning is to dance their dance. Anything can look like you are refusing to co operate and they hate that. Get your legal team on board. It was only 2 weeks ago I was told I was entitled to legal help, social work never told me I was told by my husbands solicitor! They can fight it for you which is much easier as its an exhausting emotional battle that seems impossible and never ending. As my mum tells me, they like to wear their stripes high, they have no emotional attachment and often personal opinion gets in the way of true protection.

The moment my step-daughter was taken out of our home after falsely accusing my husband, I filed papers to make sure my kids would go to their God Mother, if we were deemed unable to care for them. And when Children and Youth Services (C&Y) said we'd need to do parental fitness testing, I filed to get a public defender to protect myself, and my kids. I was given one, and then a judge intervened and said I couldn't have one, because I wasn't the parent of a child under the care of C&Y
So, I wrote, AND called my C&Y caseworker and told her that since I wasn't a parent of a child in their care, I wouldn't be taking any such test.
Furthermore, I documented everything. And when I was asked, "don't you want to work towards reunification?" I said, "Hell no!" Not after I found out that she tried to light a kid's hair on fire on her bus, and C&Y didn't bother to inform us. She's a danger to my sons and C&Y didn't care. I sent all those notes to the State Attny General's office, as well,
Basically, I was a thorn in their side from day one.
As a result, they only ever came to our home once, looked at our boys and a week later, I got a letter saying that they found the boys to be healthy and well cared for.
Oh, and I refused to sign ANYTHING unless I could have a lawyer
