CHANGE TO PUBLIC REGISTRY

JUST CURIOUS IF ANYONE ELSE HAS BEEN AFFECTED BY THIS, WE CURRENTLY LIVE IN CALIF & 6MOS AGO WHEN MY HUSBAND REGISTERED HE WAS TOLD HIS CRIME DID NOT REQUIRE HIM TO BE PART OF THE PUBLIC VEIWING WEBSITE, WELL A FEW WEEKS AGO WE RECEIVED A LETTER FROM THE DOJ THAT STATED THAT IN JAN OF 2010, A LAW PASSED REQUIRING HIS CRIME (311) TO NOW REQUIRE HIM TO BE PUT ON THE PUBLIC VIEWING WEBSITE. I CAN'T TELL YOU HOW OUTRAGED I AM BY THIS! HAS ANYONE ELSE BEEN AFFECTED BY THIS OR IS IT JUST IN CALIFORNIA?

All I can tell you as an SO is that as the laws change, we are not granfathered in like most. When the laws change for sex offenders it effects us all. That where the term painted with a broad brush comes from. No matter what type of offense the person has Victim, or no Victim we are treadted the same way, and are effected by all the changes in the lawa, In most states I can not speak for all. Just another reason why these laws are so bad. Sorry you are going through it all.

Always, you can fight that! If the law was NOT in effect when your hubby commited the offense, then NO he should not have to register on a public registry. The federal ex post facto law comes in to effect here. Ex post facto is where someone commits a crime, recieves thier sentence, then the state or federal government CAN NOT sentence them for more! It's like you stole a cookie....... grandma tells you that you are grounded for the night. That is your punishment. By Federal Law, grandma can not come back and add two more weeks on to your grounding!

In MInnesota, at least for the time being, only level 3 offenders have their photo and information posted publicly. Wouldn't be surprised if that changed someday. MN is one of the worst states to live in if you're a sex offender.

Thanks for the responses everyone & I will have my husband check with his attorney (however we had a lousy one) so not to sure how useful he'll be with this. His PO said that if he is to be listed on the website because he's a low tier offender our address will probably not be listed, but it seems no one with any authority ever has any clear answers, I've come to realize that they want to keep you in the dark about things.

In Ohio, all tiers of offenders are on the public registry. Photo, address, physical descriptions , Tier classification and charges.

In my son's case, he was charged and tried while in the navy, so it was a federal charge. The registry only says Federal Charges, so it leaves everyone to guess at what those charges are and I'm sure people will assume the worst when, in reality, he plead guilty to ONE charge of receiving child pornography. ( which in my book should not even put him on the registry) but he is a Tier 2 in Ohio and must stay on the public registry for 25 years.
