Sparkyman, have you tried speaking with the congressman or woman in your district? Unless the attorney you have is a very good immigration attorney they are not much use. the battle you are fighting is uphill, I have heard of others(RSO) still being denied after many years in the process. You definitely need some big guns in this fight, the USCIS will probably keep denying you until you give up. The risk evaluation means nothing to them, their plan all along is to not let it happen. Look for the top Attorney in your state also, maybe even ask the ACLU, you might be surprised that someone will listen. The system has been stacked against any RSO trying to have their spouse here legally and for many they cannot travel to see their wife's in other countries, all this goes back to the inaction of the many.

Sorry for the pain this has caused you. One last question, when did you start this process?

I would agree with buildingupslow....FAC doesn't do that kind of work. But ACLU is always worth a try....

Well I will put little input here although when it comes to immigration laws etc. I have absolutely no idea - I think writing a letter to the politicians is a good idea but you may or may not get a good response. Calling and insisting on talking to someone would give a more urgent appeal. I also somewhat disagree in the approach and FAC - FAC does work with and have contacts with the ACLU - it would not hurt to contact them. Also if I understand this correctly it is your wife they are denying permission to stay in the USA? Is that correct? Immigration is a hot political topic right now! If I am correct in my assumption then that would be the "angle" to use - what I mean by that is their are politicians and/or the ACLU that would LOVE to get their hands on a case where the person is trying to do everything legally and for no reason are being denied. If you think it is because of the RSO status then basically this is a case where they are punishing your wife for her association with you and that is not right. I would write a talking points paper so when you talk to these people you stay focused ont he facts and do not let emotions get into the mix.

For example:

She is trying to do everything legally and being denied. (in other words this is a good reason why many are illegal becasue the govt denies them repeatedly)

Punishing her for your crime

Etc.....

I do have an immigration lawyer, this has been going on for 5 years and my wife has done nothing wrong. Her career has been hurt as she is unable to work for now as we received the denial as me being her petioneer, I really don't know who to call anymore or talk to. I'm afraid that as soon as I say SO, they will not talk to me. A while back, after we received the denial, she was sent a letter saying she should leave the country ASAP, but our lawyer always checks as the appeal is in and there is no removal order for her. We don't know what to do right now my friends or who we should try and call
