Oh boy... What part of Texas are you in? I'm in south/mid TX and my fiance recently got charges dropped for failure to comply with registration, after a two year battle. My mother -who studied criminal justice- was thinking maybe she could find a loop hole around things because the judge in the prosecuting county (Hilsborough TX) from his original conviction had been disbarred, the DA user ruthless prosecution, and the lawyer that got him I to this mess for "not wanting to be known for getting sex offenders off". No such luck because, according to my fiancé's attorney, since he signed a plea bargain, everything is basically untouchable now; his attorney tried that route himself. You might be able to talk to a judge on the basis of feeling that your bf is not being properly represented and that the lawyer is not fighting competently for your man. That's the best I can offer with the extent of my knowledge....hope it helps!

I hate using my phone to post messages....there are a couple of errors there. I meant to say that the last lawyer my fiancé got before the conviction told him to sign the plea bargain, because that lawyer didn't want to be known for getting an S.O. off of charges. The judge refused to assign my fiancé any other attorney, as well! This was all before we got together, mind you, but because of those people, mine and my fiancé's lives are so much more difficult than need be. I'm just glad the DA dropped the charges for failure to register finally.

Florida is right in there with Texas! 5 pages of deceased people on the registry!

We've wondered the same thing. Our lawyer knew nothing about the law my husband was charged under; we're not even sure she had a copy of the most recent version of it. We also just recently learned that we were lied to: we were told by the prosecutor that he was facing 20 years in prison, but reading the law itself recently, we learned there was no possible way he could have gotten more than 10, and most likely he would have only been facing 4. Our lawyer didn't know that. I don't know if we would have gone to trial, but I think we certainly would have pushed for a misdemeanor plea and not being on the registry, if we had had that information. But, since they told us 20 years, we took what they did offer us as a gift and didn't even consider seeing if they'd go lower.

We've pretty much accepted that nothing can be done and are looking into a move to MN, where he won't be on the registry. We think that, once we are out of the state, we may begin taking steps to see if we can either appeal his conviction or get his record expunged.

I'm not entirely sure on this, but here in Backwoods County, FL.....IF a SO moves from FL to ANY OTHER STATE, THEY still have to register, even if the state the now live in does not have a registry.
Now that is some s**t!!!!

So, just be sure you moving to MN will accomplish what you want. I think there are more states like this....that you have to abide by the rules of the state of conviction, but I am not entirely sure of this. Maybe some with more experience in this state to state differences. It is all so confusing, and seems like it changes daily.
My son was convicted in GA, so I think he has to abide by THOSE rules when he gets out, even though he will probably end up here in FL with me--at least for awhile.
And @Advocate2...isn't that crazy! The page upon page of DECEASED SO on FL website!!
I guess that is the only way they can firmly state that THOSE individuals will NEVER harm another child in FL--guranteed!!!......stupid ass state....still kicking myself for moving here...

You are correct about Florida but I have always questioned that. How the heck can Florida require another state to do anything much less comply with the stupid so laws? My blood boils!

Thanks y'all. We're as Southeast Texas as you can get. I'll never know what the real story was but I do know that he was told by the judge that if he plead "not guilty" and it did go to trial and lost, then he would lose all rights to our son who was less than 2 years old at the time. He didn't really had a choice and has done everything to comply to try and make this as "easy" as possible for us. It's just so unfair. He got the harshest judge and prosecutor and we had to pay for his lawyer because I paid for his bail, which meant that he wasn't allowed to have a public D.A. because "if he can afford bail, he can afford a lawyer" The judge he got mostly handles paternity cases, so he spends all day laughing as he takes away rights from parents.
