I am now a "Sex Offender"
This is my story. I don't want it to be a sob story.
My offense was downloading CP.
It was inadvertent, I was downloading adult porn and other movies as well. I do admit I had a porn addiction. I did download those 12 files (out of 2500 other normal porn videos and feature movies) from a peer to peer service.
in early 2014 I was sentenced to 5 years probation but I had a very good lawyer, a dumb prosecutor and a fair judge. The judge recognized and said that he didn't believe that what I did was on purpose but I was in possession of it nonetheless.
He did order that I could stay at home with my wife and child. He also ordered that I could use the computers at college to complete my degree (I had gone back to school and started that process already before this happened). He also said that there would be a review of my case after 3 years, and if I was doing well in treatment and probation that I could get my sentence reduced.
That day was horrifying, I took a plea deal from 12 counts of "Sexual exploitation of a minor" down to 1. That deal said I could only be sentenced to probation if during my psychosexual evaluation I came back as less than high risk.
That evaluation was the first hint of the complete incompetency I would encounter along the way. It came back as low risk, but at one point in the report it said this exactly.
"We find that Mr. xxxxx has a risk rating of low for sexually reoffending. Furthermore we find that he has a high risk of recidivism"
They completely contradicted themselves in that part of the report. I would find out later that this was pretty normal.
The day I went in to be sentenced was probably the most horrifying day of my life. I woke up that morning not knowing if that day was going to be the last day I would get to see my child for a long long time. I was a wreck.
As soon as the judge finished the sentence I allowed myself to breathe a sigh of relief. 5 Years of probation I could deal with, I was going to be able to stay at home with my amazing wife and child, nothing else mattered.
I was told to report to probation immediately and did just that.
I sat down in the office with what I know now was the Duty Officer (the person doing intake interviews) and my soon to be P.O.
Immediately the "interview" started, I would me more likely to call it an interrogation. They told me that no I wasn't going to go home that I was not allowed to be around my son, that it didn't matter what the judge ordered.
I immediately fought back, they didn't like that one bit, I got into arguments, at one point the duty officer asked me "who ill protect your child from you?" and I retorted with "Who protects your children from you?"
I told them that until they contacted the judge I would not sign any more papers and that the interview was over until I heard from my lawyer.
I was told to sit in the waiting area. I heard my soon to be P.O. on the phone, but couldn't hear what they were saying. They came out soon after and said that the D.A. just told them that it was up to us and we will not allow you to go home. I told them that I was pretty sure the D.A. didn't have the power to overrule a judges ruling.
I heard them on the phone again 5 minutes later, they forgot to close the door to their office this time, and the judge was on speaker with her and the duty officer. In short he told them I was right and they were wrong and that I was to remain home with my family.
They told me that I could go home, and that I was to come in next week with the papers and have them signed. I did just that. Needless to say I didn't have a great first impression with the probation department, but I was going to put in the effort to try and forget what had happened. They didn't.
I was immediately told I had to do a Child Contact Assessment, costing $1800. I was rushed through it as fast as possible (I didn't realize how fast I had gotten it done until I met other SO's in the system who had been in treatment for over 5 years and hadn't been allowed to do it). I did the interviews, I took the polygraph (and thank god I passed, I am very familiar with polygraphs and how they work) and they came to my home and interviewed my wife and child.
I got word that I passed my CCA and could have unsupervised contact with my child. I'm almost certain my P.O. didn't expect that outcome because they went from all smiles when I brought in the results to all serious and said they needed to wait for their copy to arrive before it was official.
I never heard a word about it again.
Then I started "treatment" (don't call it therapy, they don't like that word).
I knew going in that I had a porn addiction, and I had promised my wife that I would try my best to use the treatment program to help me with that. And that's the mindset I keep to this day.
One thing that bothers me horribly is that I was pretty much forced to admit that I had downloaded the CP on purpose before I could "progress" in treatment. As long as I kept to the story of it not being on purpose (even the reports said none of the files had been opened on my computer) they considered me "in denial" and "minimizing" my offense and threatened to kick me out of the treatment program unless I admitted to "what had actually happened".
After that I gave in and decided to give them what they want. I put on a sad face and said they were right, I did it on purpose and all of a sudden instead of in individual interrogation sessions I found myself in group counseling sessions and they were happy and my P.O. was even happy.
Since that day, I have made an effort to talk to others in the program who have been there a while, I have gotten to know what they want from us and how to act while around the "treatment team".
My polygraphs have been hit or miss, but I have never been in trouble for a failed polygraph. It just costs me monetarily.
Each poly is $250. Treatment costs are $55 a week for the group sessions and another $65 a month for an individual session - all mandatory. If I fail a polygraph I have to do a 6 week failed poly group at $20 a week. I'm not scared of the polygraph and that helps a lot, I know it can't tell if I'm lying or telling the truth. I just find it amusing that every time I have lied to the poly I have passed, and the only questions I ever got inconclusive or deceptive readings on I was actually telling the truth.
It has been almost a year and a half and I have gotten into a routine. I go to group once a week, I only have to see my P.O. once every two weeks now and I have gotten some useful bits of information on how to handle my porn addiction and have been doing extremely well with it. I haven't seen any since my sentencing day and I haven't had the urges to watch it in the last 8 or 9 months now. So at least one thing good has come out of all of this bad.
My wife and I have been lurking on this site for a few months and decided I would introduce myself and tell my story for you guys.
She is my rock, without her I'm not sure how I would get through all of this.
I'm hoping in another 2ish years I will be off of probation and 10 years after that no more registering.
It's nice to know there are others out there who actually care, and for that we thank you.

You didn't say but it sounds like a state charge? Which state? Everyone knows that P2P downloading makes you part of the network and thus become a peer in the network for whatever anyone else out there wants to download. Sounds to me that the computer forensics did not help you at all!
I don't believe probation has the right to supersede a judges order. Did you have a private lawyer or a public defender? I hired a psychiatrist recognized by the court to perform a psycho sexual evaluation ($2,500) which stated my very low risk. He even insured that corrections matched his conclusions.
As far as "Treatment" goes that's the norm. Once your in treatment you must play the game or get reported to corrections. (That's who they work for..) Your in the system so you must play the game to save money and get through it as fast as possible.

I'm sorry you're here, but glad you found us.
I'm on 5 years federal probation, about to finish my second year and going to petition to see if I can get removed early. My wife, also my Rock, has been by my side too along with our kids (oldest is from her first marriage) and she is happily pregnant with our little baby girl. Thankfully the judge said there is no issue being with my own children - especially now that I am pretty much a stay at home Dad and day care is just crazy expensive.
I am also now going to school to finish my degree, I have to do something during this time to work on bettering myself any way that I can. Hard to get a decent job right now so using my VA benefits and making almost as much going to school as I could with many jobs I could currently get. Things will get better in the future...
Probation was all doom-and-gloom pre-trial and said I was going to jail for sure, they were surprised when I did not. I have not had a whole lot of trouble - quite the opposite since they have let me travel out of state twice now - but they just don't understand that I have a family and have responsibilities different than what they want. I try not to make trouble since I do want to get off probation early.
I am in 'therapy" too, have been for about a year now. Our first doctor was very laid back and not on track always, but our new doctor is more by the book and has an agenda that can get us out of there if we get all our work done. I too had a porn issue in general, and that's what I wanted help with most since the CP stuff was not what I was interested in but had too - forensics had proven that most of it was never touched, but still had it. The whole minimizing thing is a pain I agree, lol you sound like you're in my group almost lol. I've had 1 historical and 1 maintenance poly, and have had no issues which hopefully keeps everyone happy too.

All of it mostly bankrupted him. He really didn't talk much about it with me. I have found out more about it in the last couple of years from him because I am currently engaged to a man who is on probation for CP.
He did get through group and probation. He does have to register for life. He has been happily married for almost six years now. He got married the same year he was arrested. He has been my best friend for 15.
Keep strong! I have faith you will make it through it! You seem to have a good head on your shoulders.
My son had to take a plea. When he was 19 he accidentally downloaded 3 cp among 2300 music videos. He's a musician. He's now 25 . He spent 26 months in federal prison and is working on 15 years probation, which is a real bitch to deal with.
The judge new he was innocent, they saw our 2 sets of forensics I paid for. But they were willing to take him to trial and twist everything around. He was looking at 25 years.
But the judge said he did Not have to take SO treatment. We had to fight that one with our lawyer as his PO insisted he had to take it, and so did the POs supervisor, who came into the room when my son went there to check in.
My son is trying to deal with it all. It has cost me, a single mom now 59 y.o. over $145K so far. And it's cost my son now 6 years of a normal life.

I am sorry that so many people have negative experiences, and I am aware there are many within the criminal justice/supervision field who are absolutely horrible to deal with. Unlike many others, it would appear, I am guilty as charged and thoroughly regret the 40 years of willful disobedience to God that led to my offense. I do, however, believe that God makes new people out of even the worst of us when we allow Him to work in our lives.
For those who are looking for a ray of hope, I believe it exists. I do not have a perfect life, but I have a life that is focused on service to others and not centered around myself and my own perceived inadequacies. I have been, through my blog, very supportive of others who share similar circumstances. I have written extensively about how I feel society is approaching this very serious problem in the wrong way. I have made myself available to others on a one-to-one basis to help, and encourage them.
Recently, on my blog, I have posted articles (21 so far) written by a woman I have never met whose husband self-surrendered at the same prison I was in. Many of you will feel the sharpness of her pain and will identify with her story. I encourage you all to go there and read her words and perhaps offer your own words of support for her.

@FreeToBreathe, Yes it was state, CO. Yes it was a power play I think and I'm glad to this day that I fought back, I see them walk all over more timid and less educated people a lot but they tend to tread a bit lighter with me because I have made it clear I'm not a doormat while still trying to take my treatment seriously.
@cmckee63, Are you doing individual sessions? And only 2 polys in 2 years? I am in 2 hour long group sessions with 4 to 6 SO's once a week, then an individual 30 minutes once a month. I have taken 8 polys over 1. 5 years.
@mtbfan, I'm unsure on the laws in your state, but I can tell you how I've seen it work here. It's not law for GPS here, but your PO can order it if they "feel the need" to. They felt the need to with me. I was made t wear one until I passed the CCA. I also had to pay $15 a day for it for the almost 8 weeks I had it on. Also it doesn't have to be ordered by the judge for it to be law. Like here I can get permission to go some places from my treatment team but never a park because it's the law, even though the judge never specifically ordered it. My advice would be talk to your lawyer, he will know best. (He should at least)
@Nakohichi, I'm sorry to hear that. We were verry financially stable (not well off but comfortable) when this happened and did not qualify for a PD. We were lucky though, the lawyer we found only charged $6,000 total and let us make payments. My court and probation costs are $8,000 and now $300 a month for treatment and polygraph costs on top of it are hurting. We went from comfortable middle class to budgeting like we made minimum wage almost.
Here where I am there are very few living restrictions while on paper and none when off. Since my crime was non violent I can petition to not register anymore 10 years after probation is done.
I have treatment with some federal offenders and they have it worse in some ways and better in others.
For instance, unless you reoffend sexually, your sentence is definite.When it's done it's done even if you didn't complete treatment. However if i don't do well and complete treatment my PO can go in front of a judge and request an extension of my probation and from what I've seen it usually goes through.
It's like being caught between a dog and a hydrant.
Perhaps I am in a unique situation, but my PO treats me with dignity and respect, and I attend weekly group therapy sessions, which I look forward to. Our conversations are insightful, helpful, supportive, and focused on the things that cause us to act in ways we are now able to identify as harmful or even self-destructive.
