Anyone kknow the penalty for 3rd degree assault?

My son, who was EPC'd last Friday, hit a corrections officer. He was arrested for 3rd degree assault, first offense. He spent last weekend in jail & was bonded out on Monday for $5,000 (10 %) His court date is May 4th. Does anyone know what his punishment might be? We live in Nebraska. One attorney says he may get 1-2 years in jail, another says since it's his first offense, he may receive just probation & a fine. I am SO scared for him. According to him, he hasn't had a drop to drink in the last week & has enrolled in a treatment program. He wont admit himself into rehab, & says he can quit on his own. I of course, am skeptical. Im trying to be positive, but I am scared he will get drunk & threaten suicide again, and have to be ECP'd again. Being as this is the 3rd Friday, I am hoping & praying we don't have a repeat of the last 2 Fridays. Any thoughts would be appreciated. Thanks

I don't know...you can probably google it. My son threw a shoe at his co in jail...got all privileges taken away...guess he missed.
good news is that if he is in jail he will be sober and safe and they get out on good behavior earlier than sentenced.
it was just one more bad choice by an addict. A week is nothing for not drinking. he is not sober, just temporarily not using...

Getting a psych hold for him or time in jail could be good things...maybe he will get sick of this crap!

Assault while incarcerated is a minimum one year sentence, but being on an EPC hold is not the same. There is a different statute for assault on medical personnel. This can all vary depending on past offenses, etc. (This info came from my brother who is an attorney in Nebraska). We all know that it is case-to-case dependent. I myself always hope for the best and prepare as much as possible for the worst. Then I try to take a deep cleansing breath and let as much of it go as I am able, because I cannot control any of this. Easy to say and hard to do, I know. I will be picking up my son (opiate addict) this week. He has been out of rehab for a week now and has been staying with my parents and my brother. The hard work will begin for him and I hope he is strong enough spiritually, emotionally, physically and mentally to see it through. I hope I am strong enough to do what I need to do to take care of myself while being supportive to him in ways that do not drain me emotionally, physically, spiritually and mentally. I will be thinking and praying for you and yours.
