Is Tithing Considered a Viable Expense in Divorce

My husband lists his tithe as an expense. If tithe is still 10%, that makes his contribution over $13,000. Can that be negotiable in a settlement? Anyone have experience with this?

PS: Are we talking about personal contributions or company incorportation contributions?

Personal contributions and donations.

IMO, it should not be included as an expense as it is a gift. If he wants to tith 10% after the divorce it will be diminished as to what he can now afford. Donations should not be considered in the equation.

KRK, I'm starting to realize that more and more…wolf in sheep's clothing. Here's an example, I took my daughter to a doctor's appt. yesterday. She should have able to drive there on her own. But, I'm driving her car because her dad is causing terrible delays in buying me one. While we were in the car, she asked if she could have her car on Saturday from 9-2, that a friend had invited her to do something. Normally, I would have been glad to do it. But, because of what's going on, I said no, that she'd have to talk to her dad about it. She said, "But, I want to take MY car." I said I understood but that I can't be without a car. She was so frustrated and understandably so. It was a weak moment and I said that dad was causing us all to be inconvenienced, which he is. She got on me for being down on dad. I wanted to scream but didn't. She calls her dad at that moment says, "Dad, can I borrow your car on Saturday from 9-2? Mom won't let me have mine." He asked her what for. It shouldn't have mattered! But, he said, "Sure, I'd be glad to let you use my car." Looking like the good guy in her eyes but he's really the BAD GUY. I tried to explain to her what being inconvenienced is. She didn't get it. Aarrgh.

I am a practicing Catholic and no, we are not obligated to give 10% of our income to the church. We give what we can. He is trying to weasel out of his obligation to you. Let your lawyer handle this. And do not back down when the push comes to a shove. Stand tall and firm. Hugs

Thanks, knuckle. Appreciate knowing that. I'm ready for my attorney do some real arm twisting. I don't see that yet. That's why I feel so unsure of everything right now. Just scared because of how important all this is.

Goldengir - I just read your post about your daughter and the car. Please help me understand. Why couldn't you let her have her car on Saturday for 6 hours? Why can't you be left without a car for a short time?

I used tithing as a expense, also make-up, and gym expense, anything I could use.

Makeup, and gym make sense to me. Tithing is a donation that you make. I just don't feel like it's the same.

Sorry, I forgot to mention. In Canada any tithing is tax deductible. So are political donations. I have American relatives that use them as tax deductibles. I would check it further. Those ex's make Stephen King seem like an amateur fiction writer.

I have no doubt whatsoever that he "using" the tithe expense for a purpose. The guy is all about money. It's not about the church. It's about him and any financial advantage he can get.

I claim my tithe on my tax return. It is considered charitable contributions and I get a statement from my church listing them for my taxes
