at your age, u can probably file a motion, it's a paper to ask the court for a change in your custody arrangements.

then, have your mother also file one. for your piece of mind, maybe you can retake what tests you're talking about.

also, how does your mother feel about you living with her? and, will your father fight it? just some things to consider.

Do you have a social worker. They are supposed to help you with these kind of decisions and issues. I hope it works out well too for you.

Whose house is it you want to leave? You could file for "Emancipation", but the courts would want to know how you intend to support yourself, and whether you have enough money saved to become independent. I don't know if that would solve your problems, as the school issue seems to be in the way. Maybe you could be more specific about what "testing" you are referring to, SAT's are standardized, so it must be something else. Plus, there must be some kind of equvalency with regards to the testing in your state and the one your mother lives in.

The motion ElenaNJ is talking about is "emancipation". Declared an adult ahead of time. At age 17 my guess is you wouldn't have any problem being granted that.

if this is what you decide to do, i know you will do it with the same maturity that you've approached everything else. given what you've put up with all this time, telling you that it's just a few more months is easy advice to give. but you've been through so much already that it's not surprising that you want out now...

but here's the thing, if you start this process, how long might it take? would it be "easier" to ride it out (and i KNOW that things are truly bad with your dad so i know riding it out is really difficult)...

SA yea it would be easier to ride it out...and after summer i just would have 10 mos left..its just this house get worse for me everyday theres no break mentally, verbally, even some physically..i get stomach aches alot here

Are you living with your abuser?? You are still being abused?? My advice to you is school is school and you will be tested as to your ability and previous marks don't worry about school, worry about your well being and safety. Pack up your stuff and GET OUT OF THERE NOW!!!!!!!!!!!

you need to do what is best for you. 10 months is an awfully long time to live in an abusive situation that is making you sick. im sure you are not the only person to ever move states in the middle of school. surely there must be some procedure in place to do this. they cant make you start again at kindergarten! good luck!
