I cant sleep...so i decided to come on ds and ask your advice on something.

I've been struggling with various physical and mental health issues for almost a year now...on dec 21 i was riding the city bus to a recovery meeting...when 5 minutes into the trip the driver had an accident (pretty sure it wasnt his fault)...anyway of the 8 to 10 passengers only 2 claimed to be injured...not seriously but injured as a result of the accident. I am one of those two. I bumped my head on the metal railing...within less than 5 minutes I had a golf ball size knot on my left eyebrow...within two days I had a full blown black eye! Although I didnt go to the er, the next morning I did go to the dr to have it documented. Then the holidays came and went...jan and feb came and went...and now, after an incident on another bus last month...I find myself wondering...should I contact an attorney?...is it too late to file a personal injury claim as a result of the accident...what are my rights and what should I do?

OK...well thats all for now...I am gonna try to go to sleep now.

As long as you have it documented no its not too late.theres a statute of limitations on filing a claim. I would call a lawyer or 2 or 3 , that give free consultations. They can tell you the ins and outs and if they think you have a case

Why would you even think about suing? What for? It was an accident and you had a minor injury which is healed now. What would you be seeking?

I have to agree with darkenedheart on this one. Suing any public service hurts everyone in the long run. If there is/was no permanent damage (ie brain tumor) why bother. You make a claim...transits auto insurance covers your claim...transits premiums increase and to cover those increases the bus fare has to increase. Mine is a simplistic view but its what happens if transit is confronted with many claims.
Legally I too recommend consulting an attorney BUT no medical documentation to substanciate your claim...no physical proof I would have to say you would be wasting your time.

I am not a lawyer, but I think you have up to two years to claim. I know my brother barely bumped into another car and almost 2 years to the date the other party sued my Mom's insurance company and won. Good luck to you while riding on the buses.

The fist thing you need to ask yourself is "Are you truly injured ?" From your post it sounds as if you incurred a bump and a black eye. since you did not post any recurring or lingering affects from it, i'm assuming you have healed. You need to ask yourself , "Is filing a claim something that is moraly right for me" .

What happened in the other incident ?

Bumps and bruises are a part of life.

You are not likely to find a PI attorney to take your case. Personal Injury suits have to be justified on the basis of 'extent of injury' loss of income, medical expense, damage to personal property, etc etc.

The attorney would probably tell you you have not suffered enough 'injury' to make a suite worthwhile.

What WV said, then the attorney will send you a nice bill if they didn't already make you pay up front. It is based on lack of income or somehow interruption of what you are normally able to do. You will have to decide if that applies or may in the future.

The only way I can see you having any type of lawsuit is if the driver was actually at fault because he/she were impaired by booze/drugs.
