As the article points out Medical and Insurance companies consider only the lower range. I figured neither is likely to change its policies anytime soon, therefore people will just end up getting sicker and sicker till they "qualify". (I've always felt the requirements for the 6MWT were dangerously too low for some people I knew.)
However, I happened across a couple of sites (which for the life of me I can't find now - when am I going to learn to bookmark? Smile) that talk about how a number of tort lawyers and firms are just warming up. Smile.
