I called the Legal Aid and was told they don't help with the kind of issue I have. So far, there are no places that I can get free legal help to sue for the fense. The present owner of the house next door, who said, he didn't mess with the fense and that it was not there when he bought the house, is supposed to talk to the company he bought the house from to ask what happened about the fense. I called him today and he said he had not called the person of that company yet and will do it today. I asked him for the person's phone number but am not planning to call her yet and am waiting to see what the guy says. It looks like I may run into a dead end if that other person said they didn't kill the fense.

I talked to the plumber. He said he e-mailed the estimate that was being held up for three and a half month in their office to the woman at the city today. I left a message for the woman about the guy sending her the estimate through e-mail. Thanks for your prayers.

I send prayers that this will be resolved. Typically in the USA, one can not sue the government.

When you bought your house, you should have gotten a survey. Pull out your purchase documents you got at closing. Look and see if a fence is shown on your property or the neighbor's property.

Our awful neighbor had a mutual fence between our properties build almost a foot into her property. So all this time, we thought our property was a bit bigger. We paid a good company (expensive) to build us a new fence as the flippers had someone do a terrible job, posts too far apart, concrete holding the posts not done right either. And this good fence company owner noticed the fence discrepancy. We built the new fence on our side of the property line, on the property line and we now have two fences about a foot apart. The neighbor is so awful, we don't talk to her any longer. She has rats and has refused to do anything about them and would not give us her phone number.

The present owner of the house acknowleged from the beginning that whatever fence that used to be there was our fence and that it existed. My complaint is either him or the company (Real estate or bank) they bought the house from tore down our fence and took all the pieces with them except for two pieces. This new owner and his wife's cousin said the fence that I said had disappeared had been gone before they bought the house (how they put it was "There was no standing fence in this part.") but there was proof that there was a fence there. This part of the missing fence is not the whole fence. There are other parts that are still standing. The new owner didn't see that missing piece of fence because it was removed by the company he bought the house from.

This owner of the house is still supposed to talk to the company he bought this house from to ask whether they removed the fence and why. Their reply could be that they didn't remove anything or the whole 20' long fence was lying on the ground because the strong wind or tornados knocked it down, and they had to clean up the pieces. The owner of the house said whatever fence that I said was there was already gone when they bought the house. I don't know how this fence situation will end. It probably ends with me being depressed and feeling robbed. That company will lie to avoid having to pay to replace the fence and said that big piece was already gone before they repossed the house from the previous owner. The previous owner can testify there was a fence and that missing part was there but I don't know whether anyone can find them. However, something positive (a big miracle) just happened. The plumber guy e-mailed the estimate to the woman at the city today, and I called her (left a message on her phone) to tell her he did, and a few hours later, the plumber called saying he got the payment of the work approved (today) and is ready to come to repair the kitchen faucet and replace the water heater. He will come on April 23. I called the woman at the city to thank her and was able to talk to her in person (on the phone). The plumber knows our application for help with the water heater and kitchen faucet repair was put in last year in April. The woman left us with no hot water for one year and passed the winter. I think it might have become an embarassment (immoral and even illegal). She obviously intentionally blocked the help by saying she didn't know when we could get the help and her plan was to tell us they run out of money. This is very heartless of her. I am glad I didn't lose control and cussed her. As I said I would shoot ourselves on the foot by fighting with her. It was God who gave us the help and made her have to do it because the plumber must have pointed out that it was unacceptable morally. We never had to go without hot water this long. I am sure this woman hates me and wants me to die and quit harrassing her for help.

I think you are going to have to take someone to small claims court about the fence unless you can be the squeaky wheel daily to make the person who did it pay up. The problem as you stated was getting folks to give you an affidavit that the fence was there at such and such a date. People get squirrelly and don't want to admit or be a part of something that they see as not benefiting them in some way.

I happened to read online that in some cases, home insurance will pay for situation like this. I decided to file a claim with our home insurance and they are processing it today. The way it is going right now, there is $1,ooo deductible amount that we will have to pay. They will come to look at the area and give estimae of what they think it will cost to put a fence there, and I believe they will give the amount, and I have to get an estimate from a fence company, If it costs more, they will pay the additional amount. The whole length of the fence will be longer than 20' (could be 30') plus the small gate. The person(s) who messed with our fence seem to not know the rules (law). I didn't know them either until I went online to search for some information. What these people did fell into the category of vanderism and theft since they pulled out the fence's polls and took the pieces of the fence that they pulled out with them and destroyed the gate. They left some pieces on our yard. What they should have done was coming to tell us that our fence fell over on the ground on their territory. We might want to repair the fence instead of tearing it down which was what we did the past 36 years (not demolishing it). When we couldn't afford to repair, we just left the polls and whatever that was left there and waited till we had money to repair it because it is safer for us to have the fence. Maybe these people thought they did us a favor by tearing down the fence that they claimed fell over on the ground. I read online that if a home insurance company pays for a fence in this case, they will go after the person who caused the lost of the fence to collect the money they pay to the claimers. I don't know whether this insurance company (Progressive) will go after the person or not and if so will they be able to collect the money. It will be cheaper for the person who tore down our fence to settle with me instead of me having the insurance company be involved but she got off the phone right when I was still talking to her and said she would call me back and never did. It seems like she thinks she can just get away with it.

They told me we have to pay the $1,000 deductable. I think according to the coverage in our policy, it covers this incident based on our fence being destroyed. I am now wondering whether whoever tore down our fence thought the fence belonged to that other house. I don't understand why they would demolish out fence without asking us first (whether we wanted that done). I think the insurance company may not cover fences that got busted by naturally disasters, I am not sure. How I ran into this insurance covering fences was my daughter told me she read that it is common that people get into conflicts over their houses' fences, and she told me to google "My neighbor destroyed my fence." I feel depressed and sad because this part of the fence had been there for 36 years and blocked the sight of our exterior basement door. We have been with Progressive home insuranrance for about two years and three months. I think this new fence will cost more than $1,000 if it is done by licensed a licensed contractor. We probably will end up paying more for the home insurance but for us to not having that part of the fence will be like inviting thieves to break in through the back part of our house where my daughter's bedroom's window and bathroom withfdow are at.
