I have a court date soon. My ex has been out of work and wants the monthly obligated amount lowered. I understand that. What I dont understand and that I'm afraid the court might not see, is that he needs a real swift kick in the rear...because he doesn't clearly understand things. There is no motivation there to get employment. He will come across as if he is doing everything. I know he will lie. But the real him ...thinks about only himself. He has always worked multiple jobs even when he was laid off in the past. But not this time. He can't even get a min wage job to help fill part of his financial resposibiliy. I dont get it !!! My children are wonderful and he doesn't see that he is hurting them. Does anyone know how it works when an obligation is lowered because of unemployment ? I was told that they will at least...base it on min wage 40 hrs per week, plus other factors such as medical and child care that I pay. If they base it on min wage rather than what he is capable of making if he was working.....I think I'll be getting the bad end of things.
As it is now, I haven't gotten any CS for 1 1/2 yrs and he owes alot in back support. I just don't know what to expect. I do have a good attorney so that makes we feel somewhat good. I just hope the court sees things for what they are.
